I believe these are the 100% of poverty level guidelines, not 125%... the figures for 2013 are $380 higher (for a 2 person household, 100% of poverty level) than in 2012, not smaller.

125% of the poverty level for a 2 person household will be $19,387, up from $18,912 last year.

While we're on this topic I have a question that I'm still not clear about in regards to this.

If your income is greater than $19,387 a year that means you don't need a sponsor? My income is $33,250 a year but I don't have that much saved up yet because I just got back to the US in August and it took me awhile before I found this job (have been here for 3 months). I'm worried that because I don't have that much saved in my savings account that will be counted against me.

But...from what I've read, as long as my income is high enough, what I actually have in the bank right now isn't as important. Is that correct? Saving is so hard when they keep tacking on fees and I'm paying rent for a house where we can live!

Please, please, please, let me get what I want! ...got it [almost!] next step visa interview!

So I would have to follow these guidelines even if I received noa1 in November of 2012 right? Since we will be having the interview this year. Also I live in Houston and our cosponsor in Chicago. Will that be a problem or a reason to be denied since I live in Texas and the cosponsor in Illinois. Another thing for the aos after marriage will it have to be the same cosponsor? And we will need his past 3 yrs of income tax?? Or how does the aos work?

No. Co-sponsor can reside anywhere in the US. You do not need the same co-sponsor with the I-864 for AOS. You need to list the last 3 years on the form but only need to supply the most recent year. Read the I-864 instructions and read the AOS guide here on VJ to learn more about that process.

Only if self-employed, otherwise they provide letter from employer and most recent pay stub(s) to prove current income. That goes for both the I-134 and I- 864. Your co-sponsor has a household size of 5 before adding the beneficiary?

thank you Jay-Kay for the information. Most of my questions were answered. nut my main issue right now is do I have to follow the Poverty guidelines for the year 2013 even when we filed in November? I still do not understand how they based of the income? And as to your question yes our household is 5 and with my fiancee will be 6 people. And my dad is not self employed he works for a construction company. For the 2012 poverty guidelines he met them with 2012 income tax gross income. But, how will this work for this year? will they use the 2013 poverty guidelines with his gross income from 2012 taxes? I hope you can help me. Sorry for all the questions.
