Applying for I-130 for my daughter only not my husband

Hi everyone

Me a USC my husband and 2 yr old daughter are ukc, my husband has his own business in uk and wants to postpone his visa application , so would like to know can I apply just for my daughter and not his, ?? Maybe do his at a later time

Also I live in uk is it easier for me to apply from usa for 1-130? Or more complicated

In the right hand column is a link so you can see if you meet the requirements to transmit your citizenship to your child.

If you can’t, there is no problem with you petitioning for them one at a time, you will just need permission from your husband showing he’s okay with her leaving the UK.

Unless this is your biological daughter who does not qualify for US Citizenship through you, no, she cannot proceed her natural parent to the USA as your stepchild. Please clarify the relationship and whether natural or step child. If natural child, are you certain she doesn't qualify for US Citizenship through a Consular Report of Birth Abroad?

Might be a bit easier from the states, but def a LOT faster if you file while you're still living in the UK.

Hi

She is my biological daughter , I did apply for her citizenship from London office but got declined as I needed further proof that I stayed 365 consecutive days in usa , the proof that I had was not enough , they wanted to see stamps in my passport to see when I entered and left , they told me to pally for family immigrant visa.

I've decided to go back to usa with my daughter , as my husband has a business here so needs to be here for at least a year & also he has a very sick mother , so I wasn't sure if I could just apply for my daughters visa first ,

In that case, yes, you can file the I-130 for your daughter, who will later apply for an IR2 visa. In this situation, your daughter will be a US Citizen once she enters the USA using the IR2 visa. You can then simply apply for her US Passport. No need to apply for a certificate of citizenship unless just want it and don't mind paying for something not needed.
