Hi everyone,

I am waiting to have a interview for my 10 yrs GC and I'm also debating if I wanted to apply for us citizenship. So anyway, my question is , if I file married but separate, is it goin to affect my status as a GC HOLDER and if I apply for US Citizen is it going to put it in risk? I wanted to make sure I am doing the right thing.

Take note: I'm still married and inlove with my husband :)

No it won't affect anything. Lots of people are married and file separately. It's your decision, and is not suspicious in any way.

04/04/2022: Check for passport cashed.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Hi thank you for respond. I received an RFE And now I'm waiting for them to give me an interview date. I am worried if I filed married but separate they will question me about that.

Question what? Why they filed separately? Many people file separately. My wife and I filed married separately because she is still dependent under her mothers insurance and taxes and she is under 26. Therefore, it is logical to file separately. There are many reasons why people file separately.

there are many reasons, you are correct. but they could ask to know the reason. Most likely you will get more refund if you are filing jointly. and most of the people who go through divorce they file separately , so for uscis they could look into anything just to question it. I am not saying you would have a problem if you file separately however it might make them question that. This is my opinion

Absolutely !

and the member who asked the question didn't mention what kind of RFE she got, is it request for more proof or they asked about the tax return and that's why she is concerned. I hope she provides more information.

Hi,

I also have the same question about filing joint tax. Me and my husband filed 2012 tax jointly and we were planning to file separately this year 2013 because he's independent contract (Self employed) now,my question is, since my GC expired on June and I'm going to file ADJUSTMENT OF STATUS by April, Is filing 2013 tax separately will affect my status? we only have Joint in Bank accounts and joint in 2012 tax.. So if we file for my adjustment we only have 2 Joint accounts to submit.,is it enough? Thank you in advance :blush:

You can file married separate, but maybe some advice from your tax professional would help and you might save some money. As far a joint accounts, how about AAA, Costco, Sam's Club, Insurance auto, life and home, joint club membership's, Medical showing joint, 401k beneficiary etc., I hope that helps.

Me and hubby filed our income tax as joint since we got married in 2007. the last 2 years we filed married but separate income tax I am now a citizen and i had no problem at all. they asked me why and i gave them the truth the real reason why.
