advice about poverty guidelines

:( before filing i just want to make sure there's a solution for my problem.. i don't think i can meet the poverty guidelines with my tax return this year can anyone give me some advice if what i can do?? your advice will greatly be appreciated.. thank u.. us embassy manila doesn't realy accept co sponsor so i need other solution.. sjud i open a bANK account AND put savings in it ANd let my brother help me put more money in the account or something?

OK. To start: You have'nt Filed the Petition yet. Thats a long waiting period.

Are you working now to start saving paystubs?

The bank account should be over $60,000.00 for 2 and still a supportive means of income if even part-time income.

The Philippine Goverment will be looking at Currant Income but will also want past returns. It's going to be their decision.

Besure and File before the 2 year Rule of meeting.

Thats a start. questions: Oh theres people here that will answer.

More concerned about your current pay. Get a second job if you are below the 125% poverty line.

Really the Philippine government is going to look at his current income? I believe you mean the US. embassy Manila.

One sure way to have the embassy accept a co-sponsor is to go the married route IR/CR-1 visa. But if you are going the K-1 visa route no matter, you can improve your odds of having a co-sponsor accepted by using the I-864 (you and your co-sponsor each complete one) along with the requested I-134c.

If you want to do this without a co-sponsor and your income is short of the 125% requirement http://www.uscis.gov...form/i-864p.pdf the you need to have assets to cover the shortage, not sure where someone ( :bonk: ) came up with the $60,000 number without knowing your income shortage - ignore that number.

What Cash Value of Assets is Needed?

The total net value of assets, less liens and liabilities against them, must equal five times the difference between the sponsor's income and 125% of the poverty level for the household size

I'll be the one to ask, and I really don't mean any offense, but if you can't afford the poverty guidelines, is it really wise to be bringing someone into the country, someone who for months and maybe years to come, is going to be solely dependent on you? You will still expenses in the thousands of dollars as well for all of the fees for application, medical, another thousand dollars for adjusting status, flying her over to the united states, health care, food, everything. Not to mention a $300 magic sing karaoke machine (sorry joke from another thread)

But to answer your question, I would be surprised if having assets is even enough. I mean, it would be a pretty easy loophole wouldn't it. Just borrow money from parents or a friend, get through the interview and pay it back. While I have no evidence to back it up, I would highly suspect having assets is no guarantee of acceptance. I would think they could still deny you if they really feel you won't be able to support her when she arrives. Income is what they want to see. Maybe assets is enough.

The I-864 co-sponsor is probably a better idea. But even then, does anyone here actually know if it has ever worked in the Philippines? I've only heard that they almost never accept co-sponsors, I have no data on percentages. But I wonder if the I-864 really ups the odds 'that much'.

THE 125% say i need 23,800 something but in my tax return its only 21,000 so i'm short i have a stable job is just that my tax return for this year doesnt meet the poverty guidelines i'm short for 3,000$

You need either another job to earn more income or have $9000 in countable assets (3 times the $3000 you are short in income).

Money suddenly appearing in your account will not help. USCIS is aware of this type of fraud. Borrowing money and claim its your during the immigration process, then return the money after the beneficiary immigrates. This is fraud. Don't do it.

hi hank tnx for your reply i really appreciate it.. i'm below 2,863 the poverty guidelines is there any advice u cud give me? i have a stable job i work on the weekdays should i work part time on the weekends?? if i work now my pay wouldn't be counted in the tax return because this month is we start filing for our tax returns can they look at pay stubs even if its not in the tax return??

I did an opps with my earlier posting as its only 3 times for a spouse and children, I missed the next paragraph down before. This makes it easier for you.

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guideline and actual household income.

As for getting a part time job to make up the difference, as long as you have pay stubs and a letter from the employer that will be good, even if its not on the most current tax return.

Yes using the I-864 actually helps for a co-sponsor with the K-1 visa. A few months back there were like 3 or 4 that used co-sponsors with the K-1 and were approved.

You will be short again for 2013? If so get a part time job to supplement your income. I did it for 18 months, I was comfortably over the poverty level but felt I could save more money if worked a second job for my travels to see her and also pay for the 3 tickets to get my family to me.

The I-134c is the requested support document, but the embassy in the Philippines is known for being difficult about accepting a co-sponsor with the K-1 visa, it has been found that the embassy is more "willing to consider" a co-sponsor if the I-864 is used. Still no guarantee but past results show it has made a positive difference.

Wasn't aware a K1 uses an 864 until you do the AOS?

In some situations it could be helpful since it would show the CO a joint sponsor could be obtained by the applicant if needed at the time AOS is submitted.
