I am going thru the same process, my wife is colombian, even with the fact that she was not married to the father of her son. I am told we will need a noterized statement giving permission by the birth father that he will allow his son to emigrate to the USA, I am also told that the noterized document is only valid for 60 days, so we are waiting until we get the visa package from the us embassy in Bogota. we filed june 7th, and still have not recieved DHS approved petition, now going on 8 months. from what i see i can expect another 150 days from NOA2. by the math it looks as if this process will be at least 1 year

Good luck in your process
