NVC CHECKLIST..HELP!!!!!!!!!!!

Hello,

Our packets have finally been looked at with the NVC (it took over a month from the time of mailing from Australia till they looked at them). They approved my husband's immigrant visa packet but I got an email from NVC and they didn't approve of my entire packet. Here is what they said about the additional info I have to provide...

F - FINANCIAL EVIDENCE:______________________________________

A review of the I-864, I-864EZ, I-864W or I-864A (if applicable) Affidavit of Support form and

supporting documents that you submitted has revealed that you have provided incomplete information in

your response or you have not responded to some questions.

Please pay specific attention to the questions marked in the attached I-864/A checklist. You will need to

complete and submit a new form with the changes noted on the attached checklist.

You will need to follow the instructions for the Affidavit of Support (I-864) that are posted on the

Department of State website at the following address:

www.ImmigrantVisas.state.gov. From there, you can fill out a new form online, print the new

completed form and mail it to NVC. If you are the Petitioner, please read all instructions and complete

the correct form to submit to NVC. An Affidavit of Support form is required to be submitted from the

Petitioner on each case regardless of his/her income level.

NVC will hold this case until you send us these needed items. When you return the documents to NVC,

please make sure that the documents submitted are in the correct order and stapled together, as stated in

the I-864 Important Notice instructions.

When responding to the National Visa Center, please include the bar code sheet that came with this

letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

code sheet should be placed on top of all documents being submitted for this case and mailed to the

address provided.

Here is a bit of history for our case and I explained all of this and more to the NVC...I have lived in Australia for 2 years next month. While here in Australia, my boyfriend and I got engaged and married. Our entire process of getting this US visa has been done from Australia. My Australian visa expired Feb 2012 and the govt wouldn't extend it. I had to go back to America, my husband had to stay here, as he isn't allowed into America until he has this visa I was told. I was back in America for 2 months and then got approved for a different visa to come back to Australia. For the 2 months that I was in America I got work. I explained to my employer my situation and that I wanted to go back to Australia to be with my husband. She understood and agreed to hold my employement and guaranteed me work upon my return to America. So when I did the affadavit of support for the NVC I stated that employment, had 2 letters from the comppany. My income for the past 3 years of living in America (before I moved to Aus in 2011) didn't meet the income requirement to prove that I can support my husband in America. My mom agreed to be the joint sponsor. I sent 3 years of her tax info, an employment letter from her work, pay stubs, etc, etc. From what I understand they approved of all of her information, but not mine. The letter from NVC said to have a current employment letter. The letter I sent was from December 2012.. is that not current enough?? The few paystubs that I got when I was back are not current.. they would be dated from March-April 2012. Also this job doesn't have any health insurance... could that be a reason for them needing more info? I am still employed by the company and they stated that in their letter.. but NVC said I have no current income info. How can I be earning money from this company while being in Australia?? I also stated work that I do in Australia.. would they be concerned about that? I didn't think that would matter so much because whatever income I recieve here will cease when we move to America. And what is the point of having a joint sponsor if I knew that my income wouldn't meet the qualifications...NVC is not approving of all of my info. My husband is not going to be a burden on the govt... he has 2 jobs offers straight away once he gets there! And I have work straight away too. Can someone help me understand what NVC needs from me? And do I have to re submit or re do my i-864? I had my employer re write a letter stating how many hours a week I will be working and that the company doesn't provide medical insurance for any of their employees. Do you think NVC will approve that?? Thanks in advance for anyone's help!!

Maybe I'm missing it, but did you send the following:

Your I-864

Your Past Tax Return(s)

Your Past Paystubs

You still need to provide these things.

I did send in the I-864, 3 years of the original tax forms from the IRS.. I didn't send in the paystub because it was only like 2 and they are almost a year old. It wasn't anything current. NVC told me that I have to declare myself as being unemployed on the i-864 and also write a letter stating my unemployment... though I feel like I am lying because technically, I am employed though I understand I have no current income from the company with me being in Australia. I guess it doesn't count for anything to have work already arranged to go back to...I will be earning my own money and not bludge off the government. You would think they would appreciate that, but of course not..

I didn't only due to the fact that they are so old.. NVC told me to declare myself as unemployed though. I gave them every little detail of our situation and you would think they would be able to figure it out from that...it's obvious that I am not recieving income from the company now, being in Australia. But it's guaranteed work for me when I get back to America. So guess getting the paystubs doesn't make a difference.

I know how you feel, sort of.

Fedex wanted me to fill out some customs forms claiming cost on individual pieces of an exhibit was a bringing back in the states.

I kept telling them that I couldn't do that because it would be a lie.

The exhibit is purchased in a kit and I gave them the kit price, yet they kept insisting.

It felt wrong to lie about it, lol.

HOWEVER, in my case, they eventually gave up and gave it back to me.

I don't suggest you just wait it out with immigration though lol.

I guess for their purposes, you're unemployed.

Just give them what they want?

To make a LONG story short...

I am living in Australia with my husband awaiting his visa so we can go to the States. I have been here 2 years. Last Feb my visa expired and the govt wouldn't extend it. I had to return to America. Was there 2 months, then came back to Australia with a different visa. During my two months back,I got some work. My employer understands our situation and guaranteed me work upon my return to America. For my Affidavit of Support I stated that I was employed and gave every single detail of our situation and had 2 letters from my employer with all the needed information. So I have employement straight away when i get back to America which I thought would be a good thing for the govt to see. Apparently, I was wrong.. I got a checklist today and it stated:

I called NVC to find out more about that... the letter that I had from my employer was dated from Dec 2012.. to me that is a "recently dated job letter"

The lady told me that I need to state that I am unemployed. I feel like that is a lie...I know I am not able to recieve income from that company right now since I am in Australia, but I have been employed with them for almost a year. I did recieve some income from them for the 2 months and they have a guarantee that I have work when I get back to America. I thought the govt would be happy to see that I have work prearranged straight away, since they told me that I am responsible to support my husband-and he also has two jobs offers waiting for him upon him getting to America. So does this sound right?? For me to say that I am unemployed? I guess I need to write a letter and change the info on the i-864 for the employment section. It's sad that honesty gets you no where with the govt.
