AOS form - what is the correct way to do this with 2 children?

I just got off the phone with NVC and got ALL our IIN and BIN info. HOWEVER was told that each of us will require our own 864. I understand that. But when looking at it, how do I properly fill in the numbers for our household size? Where do the children get included on the form? Are they now considered dependents?

She said NOT to list them under the section that asks for names of those who will be immigrating at same time or within 6 months because they aren't on my application but have their own.

She also said she could not tell me HOW to fill it in properly and to do the best I can! :bonk:

She did say I would only have to pay the $88 one time for all 3 of them but that we each need our own form. I'm fine with having to do our own forms but I'm not understanding the proper way to fill in the household details.

Can anyone please give me an assist on this?

No. My household consists of me, my husband (he is already here) and our 2 non-USC children that we are filing for.

I put:

A. 1 (the child I am petitioning for)

B. 1 (is me)

C. 1 (my husband)

D. 1. (the other child I am petitioning for on a separate AOS form)

My total HAS to be 4 on both AOS forms.

Hey Kazulie! This is where I ran in to trouble with my AOS and got a checklist for it. I initially had the same thought process as you and put what you had - this I found out was incorrect. The best I could explain it after receiving the checklist was that the 2 children will be immigrating on their own visas (not derivatives) and have separate immigrant visa petitions and therefore should not be included on each others AOS. In other words each AOS should only reflect 1 sponsored immigrant for each form. This seems to match what the OP was told on the phone.

So for Part 3 question 9 I did not check that box. I initially had this checked and had the other child listed but upon rereading it after the checklist it does say "Do not include any relative listed on a separate visa petition".

Then for Part 5 the total household size ends up being 3. 1 for you, 1 for spouse and 1 for intending immigrant. Each child is counted in their own petition only.

When I called NVC, my person actually told me I needed to have 4 as my total.

Gosh I hate the immigration process! Lol if you ask your question a gazillion times you will get a gazillion answers!

Thanks beejay....time to redo my AOS for the 9 millionth time!!!

Fricken' NVC man. I hate those stupid AOS forms. Part 3 and Part 5 have to match but I see where you had the other child listed as a dependant. Now I'm 2nd guessing what you need to do. We got through with what I listed but now I'm not confident that your household size shouldn't be 4 :wacko: I thought we should have been 4 but they told me that was wrong.

I hate to say it but maybe you should leave it the way you had it....

I'm afraid I have created a greater state of confusion. :(

My situation is this and I am SO GRATEFUL FOR YOUR HELP:

There are 3 of us applying to immigrate. Myself, Son1, Son2. Both children are Canadian citizens. They are the step-children of my husband who is the petitioner. There are NO other dependents. Nobody else lives with us. No other children anywhere. Nothing.

Do I leave 9 blank then since we are each on our own visa petition?

I can't update my original post but I had a GREAT chat with an NVC lady this evening who explained it as follows:

We are a family of 4.

One my form I am the beneficiary and my husband has himself and 2 dependents (both the children who are applying with me.

On each of the kids' forms they are the beneficiary and for the household it is my husband, spouse (me), and 1 dependent (other child who is applying)

It always equals 4.

I hope this helps some others as well. She was VERY clear on this and very VERY kind and patient when explaining it to me. Unlike the woman I had spoken to previously who basically told me it was my problem to figure it out!

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

The only part I'm stumped by now is section 24e Is that the person listed at the top of the entire form or is that only if someone has been added in section 24 as being included in the determination of income??
