What happens if you fail to renew 2 year GC?

- If she doesn't file on time (for whatever reason) and ends up having her GC revoked... your I-864 would be cancelled, and she would be in the US illegally. You wouldn't be held responsible for that.

Not true. The I-864 says:

When Will These Obligations End?

...

3. No longer has lawful permanent resident status, and has departed the United States;

Regarding the I-751 (ROC): it is the immigrant spouse that files, not the US citizen. If filing jointly as a married couple, the USC has to sign. The ROC is her responsibility, not yours, so forget about it. If she does file, it would be fraudulent for you to sign it, since you are not living together as a married couple.

I know a divorce lawyer must be expensive, but you have to file for divorce asap. It may seem cruel, but she is not your responsibility after that. I would make it an absolute priority to extricate myself from this situation.

If you're living in hell with this person who has multiple problems, the best thing you could do is filing for divorce. She said she had a place where she could live, so that won´t be your responsibility. The kids are not yours, and if she has made mistakes in the past that caused her to lose the custody, that's her problem, don´t get involved.

Act before she tries to do something else against you.

And if in the end you divorce and she decided to apply for ROC, she would have to send evidences and documents that show yours was a bona fide marriage. But that, again, would be her problem.

She does not wish to stay here. Can't blame her. BUT....she will stay until she gets the kids back and they can all three travel back to the UK. Now if that takes time, time past th egreen cards expiring, I wonder if she can get a one-year visa to legally stay in the US until this matter is resolved? She will stay until it is resolved anyway, no one can fault her that, but I was hoping if she does it legally she will not have any issues because of suddently being an "illegal."

The courts may decide this entire issue for us in a few weeks. It's a roller coaster ride to be sure. Co-workers say I need to get my life on MTV. I have not comingled anything for concern about where the funds will go. Indeed she has far more to worry about than I do.

Here's a good one for you. Her kids are with CPS, so if their green cards expire on what grounds can they be kept here and not voluntarily sent back? Would the county not be breaking federal law?
