It's escalated big time. She is a complete nut job in my opinion. She totaled the Porsche I got her. She has refused medical attention for a broken foot in the car accident. CPS has taken her kids and she has had more arrests. She gets visitation but needs to complete some counseling classes to get the kids back yet she refuses to go to them, still saying she is right and the world is wrong. The kids will be adopted out of she refuses to comply. The real father does not want he kids. What I want means nothing as I am a mere stepfather, never mind I am the one with the income supporting everyone. She wants me to get her an apartment on her own but I cannot afford two households. She refuses to work. I'm seeking counseling to see how to deal with all of this.

This has gone on way too long to see a cure in sight. It'll be closer to $2k for perm green cards with the kids too, but the courts have them so I do not know how to file for them if I could. I doubt my wife will go back to the UK without the kids. So if she can get them back and head to the UK before her green card expires them maybe she can at least visit the USA if she wants to. Sure she can file on her own but she has no idea how the government works in that regard and either she is too lazy or too ignorant. on one hand she wants to go home and on the other hand she has redecorating ideas for the house that will take a year or two. She is all over the map. I'm exhausted. And broke. I took away her ATM card when she was going hog wild with it.

As a result I have no intent to file for the permanent green card for her. I just see no other option.

My 2 cents based on what you just wrote: her status vis-a-vis immigration should be of no concern to you. File for divorce ASAP and let her deal with all the rest. It is sad to say this, but it sounds like the kids are better off being adopted than living with a her, with no support from the biological father. Also, you can't do anything for them if she does not comply with the order to complete counseling.

Filing for divorce is easy, but then what? She will not move out, so have her formally evicted? To the streets? I'd rather save the money from a divorce and use it to get her where ever she wants to go. I brought her and the kids here, they were fine back home, I upset the apple cart so to speak. The least I can do is return things to their former condition.

Slightly a side topic, but are you still in California? Check the regs for divorce in California - it has a cooling off period of 6 months before you're allowed to actually be divorced, and then if there's any argument about settlements, it takes even longer again (my husband was previously married in CA, took him 18 months to get his divorced finalised). Just an FYI if you do want to start that process. It's a long'un.

Six months in CA, yes, but it's a piece of paper now and a piece later on. CA is a no-fault state so there is no arguing over stuff, it is 50/50 and that's that. What bothers me about is is that this whole thing is looking like such a complete failure. And we used to be so happy. :-(

Oh, my husband's was no fault too.. but his ex wouldn't do her half of the paperwork on time etc. etc. You'd be surprised how people can slow things down!

And yeah, you're right. It's really sad and I'm sorry you have to go through this. I suppose the best you can hope for is that she'll at least be communicative enough to have her help arrange her move back to the UK. It sounds like she's sort of got herself into this, to be fair.. no one just starts getting arrested and into trouble just because they moved!

Well if she goes slow that's no biggee to me, she is the one who needs to find a new home so I can understand going slow. I did offer her gobs of cash to do an annulment and she said no.

Remember the car accident? Apparently she testd positive for something in her system and she is going to go to trial. Oh, and since the last post she has had two more arrests. She was put in jail to await trial, so in this time at least A) she is not getting into any more trouble and B) I am not being hit any more. Kids still with CPS. Whata wild ride. Very soon is the time to file for removal of conditions. NOT!

Am I the only one who thinks this whole Adjustment of Status thing is just for getting more money with the fees? If someone can apply for citizenship 3 years after living in the U.S. if married to a U.S. citizen then why require a new green card 2 years after marriage? It's all just about getting money, at least that's how I feel about it...

They should have made it three years to sync with the shorter time for a marriage visa. Oh well.

No, because a lot of people don't file for citizenship right away. Citizenship is optional. This system prevents a lot of fraud and lets people have easier AOS (with less evidence for newlyweds) which is a good thing.

Get a divorce attorney and a good one, follow his advice, do not be in the same house and put yourself at risk of being arrested. Put her stuff in storage, change the locks / move do what ever you need to do and get a restraining order ASAP, do not file any USCIS papers. A decision has been made not by you but by her, and they are not your children. Now take care of number one. This is not the time for DIY in VJ believe me I know after being in CA LE for many years.
