son`s citizenship

My question is this, my son is the son of a U.S. citizen (my husband), my son and I arrived from Venezuela 3 months ago with permanent residence, what form should fill to reclaim his citizenship? as being the son of a U.S. citizen would get his citizenship automatically right? :help:

USCIS

09-13-11: mailed I-130

09-15-11: got Noa1 by e-mail, priority date 09-14-11

09-19-11: touched

09-23-11: got I-797c hard copy of Noa1

03-14-12: Noa 2 (Approved)

03-19-12: hard copy noa2 received

NVC

04-09-12: NVC case number, IIN and BIN

04-10-12: DS-3032 sent by email to NVC

04-24-12: DS-3032 accepted

05-14-12: paid AOS and IV fees

06-13-12: Sent both packets (AOS and DS-230)

06-27-12: received checklist for AOS

06-29-12: DS-230 accepted

07-02-12: sent to NVC checklist response

07-12-12: Case complete

07-13-12: Date INTERVIEW Assigned

07-25-12: Medical

08-23-12: Interview result?

08-23-12: Visa Approved

09-18-12: Dream come true (living in the United State)

Timeline

It is not automatic unless your son was born in the US. Your husband would have had to file your son;s citizenship with a consular report of birth abroad(CRBA) at the consulate in the country of birth.

I've seen two different answers to this question.

The first is to simply apply for a passport. You'll need a birth certificate for this of course.

Now .... I've not done this myself, so hopefully someone who has been through the process can help steer you in the right direction.

AOS: Feb 26, 2007 - Jul 26, 2007
REMOVING CONDITIONS: May 4, 2009 - Oct 3, 2009
CITIZENSHIP: Nov 27, 2012 - May 9, 2013

Note: I immigrated from Canada, not T&T - the timeline is reflective of this.

PRESENT - IR-5 Story (reuniting a family)
I-130 for Parents - 2013
Aug ?? - mailed I-130 packages for both mother and father
Sept 10 - NOA1 date
Sept 16 - NOA1s received

2014

Feb 25 - got emails saying that the cases had been transferred to another office for processing

Feb 26 - got emails saying that the cases have been transferred to my local office for processing

Feb 28 - got emails saying that the cases have been transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Mar 18 - got emails saying that the petitions are approved smile.png

I can only assume you didn't file for CRBA as your husband didn't meet residency requirements to pass citizenship onto his son that way. Since his son has now been admitted to the U.S. on an immigrant visa and is now residing with his U.S. citizen father he can apply for his U.S. passport at the post office (or any US passport issuing authority) regardless of when his father obtained citizenship. Your son will need his birth certificate showing his father's name and his father will need to bring his naturalization certificate. He will also need permission from both parents to get the passport.

One caveat- if your son is over 18 I'm not sure if he is able to take this route. Someone else will have to address that.

To piggy back on the previous post above ^^^^^ if the child is over the age of 18, than the child has to go thru the regular process of 5 yrears as LPR and then he/she can apply for citizenship.
