My husband is trying to fill out the I864 and get all the supporting documents. He got an employment letter but they said they could only put what he earns per hour. They couldn't give a yearly salary as he is paid by the hour so if he is sick, takes a shift, works overtime etc it will change. So, what do we put for the salary on this form? Just his $/hr amount? Thanks!!

I was having the same type of challenge but because my husband is self-employed. You can put an estimate of your yearly total. At this point of the year, with it being the end... can he not look at his most recent pay stub and see a year-to-date amount? He can put that amount. The total amount for yearly income does not have to be exact. He has supporting pay stubs and a letter to show it isn't something he just pulled out of thin air.

It is more or less common to assume 2000 hr/yr, which includes a 2 week vacation btw. This assumes working 40 hr/week, if he is going to be working 30/week, then calculate accordingly

I'd annualize the hourly rate with 'Estimate' in front and the hourly rate in parentheses.

Take the hourly amount and multiply by 2080--the number of work hours per year and put that number on the form. Your employer's letter and the pay stubs will back that number up.

Good luck,

Dave

i would show the last few years of salary (use what is on taxes), and then show the last few months of bank statements to show your salary is still as stated. I was self employed when doing my husbands visa and i had no problems using tax returns and bank statements to show my salary.

in the employment letter if they can jsut include something like "The average monthly pay of the last six months is $XX.XX". OR if they can write, "His average working hours over the last six months is XX hours."

having this would be more helpful.
