5 months have passed and no NOA2

Happy Holidays to all of you! We just want to update you on our petition status. The California Service center received our petition on July 2, 2012. We received NOA1 sent by the USCIS

on July 9, 2012. according to the USCIS website, processing time for initial review would be around 5 months.

I called USCIS 3 times in the last week and was told by one agent that the California Service Center was not processing I-130 petitions and so my petition may have been transferred to another service center and that was it. Today, another agent at USCISapologized for the prior agent and said that I would have received in the mail a letter stating that my petition was transferred to another service center if that was the case. I never received such a letter, email or phone call.

Has anyone else experienced a similar scenario? Any suggestions on what we should do?

We realize that this waiting game would require much patience but 5 months for a security background check for me is taking sort of long don't you think?

Thank you all for your support and assistance!

Love and Aloha, Menchu and Frank

As usual, the tier 1 operatives on the USCIS misinformation line were misinformed.

Per http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c3c7ca7c5fed9310VgnVCM100000082ca60aRCRD&vgnextchannel=e7801c2c9be44210VgnVCM100000082ca60aRCRD any I-130s filed on or after 15th August 2012 will be processed by the field office having jurisdiction over the petitioner's place of residence; I-130s filed before 15th August 2012 will be processed by the previous location. If yours was assigned to CSC then that is who will process it, and it usually takes ~6 - 8 months to do so.

If you do call make sure you get transferred to someone who can actually give you real answers, an ISO. The reps who initially answer the phone really don't seem to have more of a clue than you or I.

We haven't seen any July filers at NBC, so I would just wait out the CSC. I have a feeling you'll get it soon enough.

If you don't get it in the next month, I'd put in a service request.

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

Two more weeks , we will reach 5 months point too . Called and talked to the tier 2 staff . They said the same thing as you guys ! Petition will stay at previous location if we didn't receive any notification ! And have to wait reaching 5 months to call them again ! I don't understand why some will be processed that fast , why we have to wait so long !

USCIS is anything but fair. I watch as people in some select countries get DCF filing and we have to wait with everyone else. Who knows how they rationalize things? :crying:

I'm sure if you called back and told them your petition number they could look it up for you. But looking at CSC processing times here, there is no category for "U.S. citizen filing for a spouse, parent, or child under 21." Someone on VJ said when they called USCIS not too long ago they said it was a mistake and that it should show up. They said they were working on fixing it. Try calling again. It's possible the first rep you spoke to was under the wrong assumption.

  • 3 weeks later...

Happy New Year to all of you here at VJ!! Wishing you much happiness, success, prosperity and LOVE in 2013!

Here's an update:

Today I called the USCIS and I was told that today makes 4 days PAST THE NORMAL processing time!! SO....

I asked them for a SERVICE REQUEST and obtained a Referral ID number.

Within 15 days, the California Service Center will contact me in regards to my petition. They will review my petition and advise me

of any questions or concerns that they might have (I thought they were already doing this the past 6 months...)

If I don't hear from them in 30 days, I need to call the USCIS back.

How many of you are at a similar point as we are? Do any of you have any suggestions, advice or concerns regarding this part of our petition process?

For those of you who have experienced having a SERVICE REQUEST made and receiving a Referral ID...did that expedite your petition approval?? Or prolong it?

Did anyone have their petition denied after doing a SERVICE REQUEST?

Thank you for your input and I pray that we all continue to have patience.

Frank & Menchu

Interesting! So CSC thinks that the normal processing time for I-130 (US Citizen filing for spouse) is exactly 5 months and 22 days (you had to wait from July 9th to December 31st). They used to have "5 months" on their processing times page but since December 3rd, 2012 they stopped listing I-130 (US Citizen filing for spouse) on that page. :bonk:

Today marks 5 months of waiting for me at CSC. I guess I'll have to wait 22 days more before I can make a service request. :clock:
