Have you met the first requirement by meeting in person within the last two years?

Hello,

Thanks very much for your informative response. Yes, we met last month and We're planning to meet again next summer. We phone chat everyday and spend extensive amount of time on the phone with each other. We have been in our relationship for nearly six months. He is a Ghanian and reside in Accra. I am waiting for his documents so I can begin the filing. Once that is received, I'll send the I-129F form asap since it takes long time. What is the estimated time after filing for him to get an interview? Thanks again!

It seems what you really want is someone to do the case work for you. The guides for example have a flow chart indicating exactly what is done. Follow that example. You will see that as I said before you can file the initial petition right now because the 134 is sent as part of the P 3 which is requested by the embassy months from now just prior to the interview.

If the embassy in Ghana would not accept the 134 form for a K 1 case what would they do in these cases? There are procedures to understand and follow to do what you want. Use them.

Ning, thanks for your responses,.but I'm not looking for someone to do the work otherwise I'll be hiring a lawyer instead of being on VJ. I'm looking for answers to prevent possible delays in filing. Also, I'm new to VJ so don't know how this posting stuff works. Now I know I can read other posts and hope to find my answer or just post my questions to be answered. The answer I'm seeking isn't on the guideline of the k1 otherwise I wouldn't post any post in the first place. Anyways, thanks again for contributing to my post. God bless.

I made a mistake when I responded by responding to the wrong post with what I said. I am sorry for the confusion on my part.

Hello my VJ friends,

My significant other and I have decided to apply for the k-1 visa. However, I am a full-time university student but I am currently on unemployment benefits. I have two children who aren't the finance's children and I am on foodstamp and medical benefits. Also, I have already asked my brother to be the financial support person which he has already agreed to. How will this affect me applying for him to come into the USA?

Any advice will be appreciated!

If the consulate you use will accept co-sponsors, it will have no affect on his visa.

Theres a lot of conflicting information here but the bottom line is when you file for the K1 visa you need to fill out the 134 affidavit. If your income is not enough you can submit a co-sponsor. The problem is not all embassy's will accept co-sponsors with the 134. Its at the discretion of the embassy. So do an online search for the embassy you will be using and see what kind of results you get. Have people reported they have typically been denied there with co-sponsors on the 134 or not? If so then the K1 route with a co-sponsor wont work.

If you go the spousal visa route you do not use the 134 affidavit, you use the 864, in which co-sponsors are allowed (no exceptions anywhere)

So you need to do some research, because if you file with a co-sponsor on a 134 in a location that typically denies co-sponsors, you just wasted a great deal of time and energy on a petition thats most likely going to be denied. Leaving you with no other choice then to get married and pursue the spousal route, whereas if you were informed, you could have started that route at the beginning.

Thank you very much. I'll use the I-134 form instead. Yes, Ghana accepts the Co-sponsor form.
