Hi,

I have a question concerning how long prior one can file for the fiance visa when the aline fiance is still in the USA?

Right now, I am doing an internship here and won't leave the states until mid February. I was wondering if we could already file the fiance visa,

so that I can get it earlier because we would really like to get married in the Summer. Are there any complications to file it when I still have about 2.5 months in the USA before I go back to my country?

Thank you!!

Welcome to the forum.

When to file? When you have properly and completely filled out all the requisite forms, collected all of the necessary information, and followed all of the instructions. Realize that the beneficiary will have to return to their home country to have their visa interview. Take a look the K-1 flowchart, located in the "Guides" tab, accessible at the top of the forum page, for some general timeline information.

Good luck on your visa journey.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
