G-325A, Need help for 1 question

Hi there! I have a question regarding G-325A on how I should answer the question, "applicant's employment last five years". I resigned from my previous job back in april due to going to philippines for vacation for 4 months (april-august), should I write unemployed between that period? Any answers will be much appreciated. Thanks for your help :)

If you resigned, then yes, write that period as unemployed.

You could do it either way - I think I and other people have just assumed that USCIS could figure out that if you were not employed, you were unemployed. It worked out just fine with my I-129F. Although, if you are currently unemployed, you should list that.

Yes, you have to write unemployed and the dates also. Don't leave any gaps in time.

If that works, it works. However, the forms are specific in not leaving any gaps in time. The men and women of the USCIS are experts in retrieving your immigration history, but never rely on them for logical reasoning.

Oh GREAT. I left a big gap in time on my husbands from 2007 to 2010.

My paperwork just got an NOA1 last week.

Is there any way to fix this to avoid an RFE? Or do I just have to wait it out?

Or is there a chance for it to go through anyways?

I actually looked it up on visajourney before I sent it in and found threads in which other people said they sent it in with gaps and no problem. I googled too and couldn't find any RFEs for people filing for I-130 for employment gaps not listed as "unemployed".

Although, I think ours were just a few months here and there.

I guess you'll just have to wait and see. B-)

It says to state 'none' if applicable, but I took that to mean if you had none at ALL in 5 years.

And the instructions page aren't exactly instructions lol

The instructions say to not leave gaps in time, but it seems like a lot of members here are fine either way. But in general, leaving anything up to a USCIS adjudicator to go figure out can just as easily result in an RFE. That's worst case scenario. They won't deny your petition.

Where does it say that?

Are there actual G325a instructions?

Because the only ones I could find are on the second page of the actual form and say squat that could help anyone fill out that form.

"if none, so state." I see now in your previous comment you mentioned that you saw it. I suppose that part could have been "instructed" clearer. You'll be fine though.

I still don't know how they can call that second page instructions lol.
