Today my wife called me and she was crying and very sad. she told me that she wanted to do some documents and that after she finished doing it, they did not put my last name( Oyetunji ) instead they put her former name Peete, And we have changed her name and all details including SSN after our marriage because we got married here in Russia where I live. She got a reply after she have asked why they p0ut his former name and the reply was that they did not recognized our marriage under Georgia common law marriage since we have lived away from each other up to 3 months. Now my wife is crying that this may make USCIS not approve us. I tried to tell her that we did not get married in Gerogia or USA in general that USCIS should be able to know that we need to follow the protocols and we can't just jump the hurdle like that and they should respect that, but she is adamant and believed it will destroy everything. my question goes thus, is this really through ?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

we got married here in Russia through the legal means registered under the Russian marriage.. and we even went to American embassy to get letter before we got married as in Russia they need it to know that she can marry and she is single which we did and everything went well and it is legal . but now i dont know why goergia common law will invalidate our marriage. i'm confused

we got married here in Russia through the legal means registered under the Russian marriage.. and we even went to American embassy to get letter before we got married as in Russia they need it to know that she can marry and she is single which we did and everything went well and it is legal . but now i dont know why goergia common law will invalidate our marriage. i'm confused

If you are legally married in Russia with the applicable government issued marriage certificate, the USA will recognize your marriage for all purposes including immigration, regardless of how the Government of the nation of Georgia regards your marriage. If you mean the US State of Georgia, the answer is the same.

Georgia State common law is irrelevant, as your marriage is not "common law". It is a "legal marriage", not "common law" marriage. Common law marriage is the label given to people who do NOT LEGALLY MARRY but otherwise meet a State's "common law" marriage criteria. If not still, it used to be that in the State of Texas, a husband simply referring to an otherwise unmarried woman as his wife, satisfied common law marriage. Don't give it another thought. Legally married is legally married.

Georgia State common law is irrelevant, as your marriage is not "common law". It is a "legal marriage", not "common law" marriage. Common law marriage is the label given to people who do NOT LEGALLY MARRY but otherwise meet a State's "common law" marriage criteria. If not still, it used to be that in the State of Texas, a husband simply referring to an otherwise unmarried woman as his wife, satisfied common law marriage. Don't give it another thought. Legally married is legally married.

But wont this be an issue for them since USCIS is referring to Common Law. Why did they even bring up the matter of common Law to op's wife? I am not an expert in this area but I would tell your wife to make sure they have you guys are legally married, not marriage through common law

@QueenE Our marriage is legal. we got married legally here in Russia .and my wife was afraid and thought not living together for 3 months has invalidate the marriage because of a document that she collected which was in her former name that is why and VJ members have explained to us now that common law can not affect us since we didnt marry under common law. Our marriage is legal

USCIS didn't refer to common law. The US Citizen spouse simply had an errant thought.
