France and Jamaica requesting the I-864 at the K1 interview stage?

it was requested for me because the CO only looked at my 05 tax return...never looked at what i am making currently which is double poverty line...so she gave me a 221g for a co-sponser or to wait till i file my 06 taxes...she requested the co-sponser to filll out the i-864 form...which i think is crazy!! and was told that is crazy they shouldn't be asking that since it is a k visa....but must do like they ask...

Did you offer pay stubs, banks statements and an employment/offer letter to substantiate your current income?

For the Consular Section to require an I-864 or ask to see your 2006 tax return is damn peculiar.

Why not inquire about the above evidence in lieu of the I-864 or 06 tax return? Plan for success!!!

i gave the girl EVERYTHING!!!!!! and i told her that for the last year i had made more then over poverty line and she said that they are basing EVERYTHING on 05 tax returns....i was very upset and confused because i make enough why do i need a co-sponser?? i gave her all my paystubs and my work letter and i even copied my last 3 checks...and that was not enough....

she asked for either or...co-sponser or 06 taxes when i file...

i know i am thinking this will all be over after he drops off the paperwork and will coming home :)

In Packet 3 that my fiance received, it requested the i-864. I asked him several times was he sure because I had already sent him the 134 and americanwoman and sleepless in oregon, both used the 134. However, when the Paris embassy guides were updated on visajourney, it now says the 864.

Interesting. And the visa pages on the web site of the US embassy in Paris are not very helpful with regard to the K visas.

Since you've already prepared and sent over a financial sponsorship package including I-134, why not have your fiance try a little experiment? Send him an I-864, but have him submit the I-134 and keep the I-864 in his back pocket (literally). Let's see if they accept the I-134 or if they refuse it and demand an I-864.

If he's really brave, have him ever so politely and humbly show them N4b from 9 FAM 40.81 (Fiance(e)s) Notes, where it says

"K-1 and K-3 applicants are subject to INA 212(a)(4) and must demonstrate to the consular officer's satisfaction that they will not become a public charge. The Form I-864, Affidavit of Support Under Section 213 A of the Act cannot be required. ... The Form I-134, Affidavit of Support, may be required when the consular officer deems it useful." (The emphasis is mine.)

and find out what they say before he turns over the I-864 if they continue to demand it.

Well, I have decided to go to the interview with him. There has been too much delay and if something went wrong if I wasn't there I would have a serious breakdown. I think they made a mistake about the 864. But, I have both of them, so I am prepared. I will see all the things that the embassy sent him and be able to answer the mystery after WE come back to the US. :) My fiance always states that this is not my language and not my country when I ask him any questions about the K-1 and what the CO told him.
