Please help!!

Timeline

I have a friend who has been dating a man on and off for well over a year...he actually has a 10 year visitors visa so he has had the opportunity to come over to the states (which he has done in the past) whenever he wants...well, about 2 weeks ago he came over and is staying with her until December...they've been getting alot closer and I guess the discussion of marriage has come up...he told her that because he has a visitor's visa, they can just get married here in the States, and file that paperwork while he is here living in the states, as opposed to going the K-1 route and then getting married...my question is that even if they DID get married while he was over here--I thought that he would have to return to his country until the K-3 or CR-1 (I'm not sure which it is) is done and then come back over? Is this true or not? I told her I would find out, because I'm sure someone here has gone through it or knows the answer. Thanks! :D

What the man told your friend is correct, if a bit over-simplified. There are some things to be considered. If your friend and her boyfriend get serious about this idea they'd be best advised to have a consultation with an immigration attorney to review the facts of their situation and get advice as to how to present their information.
