So guyz, I had my congressman office to contact USCIS to know whats going on with my file. I received forwarded email from my congressman (which was sent to them by USCIS):

"

Good afternoon,

This I-130 was reviewed and the officer determined that an interview was needed. The petitioner will be scheduled for an interview at a later date. We have no I-130 interview dates on the calendar through September 2013 and we may not get any until after the first of 2014.

"

Pretty much officer did see the file and decided that he wants to take my interview before approving it but they can not schedule it until January 2014. :( so i guess i have no choice but to wait. I filed on November 19, 2012. it already has been 10 months without initial approval :(. Does anyone have any idea what else i can try? Please help me :(

This is what my lawyer emailed me today.

I was at the immigration office today and checked on Nahal’s file. I spoke with one of the officers that I know well and does interviews usually. She indicated to me that Nahal’s file was in fact in the Atlanta office waiting to be assigned to an officer for review. She indicated that since August and September mark the end of the fiscal year for Department of Homeland Security, their focus right now is on citizenship and oath ceremonies and that most likely the I-130 files will not get any attention until October, which marks the beginning of the new fiscal year for DHS.

Unfortunately, the officers are no longer allowed to pull files as a directive by the supervisors were given because they are trying to adjudicate and complete files in order of date. So Nahal’s file is still pending. I will do another appointment in November if we have not received an answer on her case.

Does this sound believable? I mean can they do that? just hold files?

Thank you stevie b for that positive thoughts with regards our case. Fingers cross hope that will happen. Did you go for an Info Pass before? Hope you can tell me your experience about it. This site VISAJOURNEY really helps us a lot just reading the post of fellow members. Since my husband don't have time to go all the readings, I do it and sent him a link to read. When I came across about Atlanta Transferrers, I told him about it. He then called the lawyer but heared the same thing when he called USCIS. Thanks to BISMARK AND MRS.OYETUNJI, who really takes time to answer my inquiries and told me what to do. I appreciate it so much. and thank you also for your kind thoughts Stevie b. :)

infopass? me??

oh yeah plenty

only good thing about an infopass is an officer will actually take the time to scroll through screens for you

I am sorry to say I wouldn't have any high hopes of finding anything out other than your file really is there.. that office is a total mess

I am quite confident, although you may not want to hear this, that over the next 60 days we will see floods of approvals

this sounds horrible

cant you put the screws to that immigration liaison helping you? I would start with .. I am sorry does that sound acceptable to you?

the issue with these stupid local offices is that originally part of their routine was to interview applicants in person. this by the way not part of the process last year before they were enlisted to take care of 130's. so now folks like you are in the unfortunate position of going for an interview that in the past was never part of the process

yes I know sad.png I feel fortunate for sure, delays and all

so what is going on with your elected officials over there, are any of those immigration liasons being of any help, emails.. nothing?

I think it was the senator or congressman able to help us find out about the status of our case. imagine just sitting there in Local Atlanta office and never received a notice that it was transferred there till someone knocks at their door. :) They just don't understand the feelings of waiting and left hanging. It sucks to be stuck!!!!

At last we got our case number and invoice identification number today. i am super excited

Happy for you. Goodluck and congratulation.

this sounds horrible

cant you put the screws to that immigration liaison helping you? I would start with .. I am sorry does that sound acceptable to you?

the issue with these stupid local offices is that originally part of their routine was to interview applicants in person. this by the way not part of the process last year before they were enlisted to take care of 130's. so now folks like you are in the unfortunate position of going for an interview that in the past was never part of the process

I think it really sounds horrible but they are in the positions to do what they feel like doing of all the cases on their look out. Hope by humanitarian reason they could be sensible to the feelings of people who are left behind waiting.
