We received a blue form yesterday. The paperwork and forms were submitted at the window. The interview process went rather quickly and only 6-7 questions were asked. Then they told us they required IRS form 1722 (tax transcript) and could not approve the visa without it. I advised her that the W2 and complete tax return which was submitted has more detailed information than the transcript but she would not buy it. I really don't understand these people. I sent them every single page of my tax return and w2s from the past three years. I also got a letter of employment verification and they still want the transcript. Their own list indicated that tax returns and w2s are sufficient and acceptable. Oh well, we are just going to have to come back with the transcripts and submit it at the window. They kept the rest of our paperwork so I guess that's not too bad of a sign.

I already called IRS and they will take 5 days to send it to me. I was unable to get a hold of a live person at IRS to have them fax it. I called the (800)829-1040 number. My brother is going to email the transcript to me as soon as he gets it. Although it is bad news that we did not get a pink slip, it could of been worst and for that I have to be thankful. It sounds to me like all we have to do is get that transcript in and we should be good to go, but who knows what could happen. Wish us luck.

It is an easy fix. Something that although takes time to receive it, it is not a denial.

According to the IRS "Order a Transcript" page, the correct phone number to call is 1-800-908-9946. If you do manage to get a hold of a person, you should be able to get faxed transcripts within an hour.

Just FYI, the reason they prefer transcripts is because it proves that the return was filed with the IRS.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

My brother was able to get them for me same day from the local IRS office. Transcripts are in the mail and on the way to Vietnam. Will post the interview process from beginning to end as soon as we get this all cleared up and I get back to Cali. Wish us luck.

Just an FYI, the packet 4 instructions say:

The preferred record of income is the Complete Income Tax Return Transcript from the Internal Revenue Service (IRS) (formerly IRS Form 1722). However, W-2s and a copy of a complete federal tax return (Form 1040), including all pertinent schedules,
might be acceptable in some cases
.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

you know, this whole thing is strange.....the NVC instructions on this state clearly the supporting evidence required is complete tax returns and W2s OR the tax transcript. This is what I submitted to the NVC and it was apparently approved as it indictes such on my interview letter. I didn't find out that the HCMC Consulate office apparently PREFERS the tax transcripts until I saw OP's post. If the NVC has already accepted my documents as valid wouldn't the consulate office accept the same? Why does the consulate office give instructions that are actually contrary to the process we're told to follow with the NVC?

Luckily I saw this and I'm playing it safe by having my transcripts mailed to a family memmber and then faxed to me here where I'll hopefully get it in time for the interview.

They gave us a blue for an I 864a because of a tax filing issue and it seems that there is someone there who is taking the rules and applying them how they want to... many have used tax returns in the past, but for some reason the CO in your case said nope...

That was exactly what I read and was thinking. Since I had my complete tax returns and W2s, I figured I would have no problems. I guess when they said "might be acceptable" it really means "will not be acceptable". Any how, we are still waiting for the transcripts to get here. Keeping my fingers crossed that all we have to do it turn this in and receive a pink slip.

It all depends on the CO... one may not care and another may make a huge deal of it.

IR1/CR1 requires an I-864 affidavit of support, where the requirements are spelled out in the law, and the affidavit is submitted to NVC. K1 can't use the I-864 because it's technically a non-immigrant visa, so most consulates use the I-134 affidavit of support. There are no rules in the law regarding the I-134, so consulates can ask for whatever they want. The consulate in HCMC strongly prefers the transcript. It's more reliable because it confirms that a tax return was actually filed with the figures printed on the transcript, and each page contains a 2D barcode which makes it more difficult to alter or forge. On the other hand, anyone can download a blank 1040 and blank W2 from the IRS website and print virtually anything they want on them. Fraud isn't unheard of at the consulate in HCMC.

So Jim, what you are suggesting is that for me (IR-1/CR-1) the transcripts are not required as I did the I-864 and already accepted by the NVC with no further evidence requested? that would certainly be a relief....

Good Morning everyone. We just got our PINK SLIP!!!!! We are so happy. Thank you all. I received a lot of valuable information and insight from this wonderful community. Special thanks to Scott and Jim, I read a lot your your posts and you guys have been nothing short of amazing.

Ok, so this was how it all went down. We went in on October 22nd at 7am to get in line. We received numbers about two hours later. Our number was finally called at around noon. We both went up to the window to submit our paperwork, photos, chat logs, etc. Then she was asked to wait back in the lobby/waiting area.

They asked me the following questions: When did I get to Vietnam? Where did I stay? Where do I work/what I do? How did I meet my fiance? Did we have an engagement ceremony and if I had any family members there. How do we communicate and how often? Do I speak Vietnamese?

They asked her the following questions, via interpretor: How did we meet? What does he do for a living? How do we communicate, language? Does she think I'm handsome (lol. Then they looked at some of the photos and asked where a few were taken.

At the end of the interview, they basically told us we were very organized and had everything needed with the exception of my tax transcripts. Without that, they are not able to approve her visa. When my fiance started tearing up, the translator told us not to worry. We wont have any problems if we come back with the required paperwork. Just bring what they asked for and you guys will be ok.

So we got the transcripts on Sunday afternoon. We went back to the consulate first thing Monday morning. Again, we had to get in line and wait for our numbers to be called. It took hours. Once we got to the window, we submitted the blue slip (which stated IRS form 1722 is required and a visa will not be issued at this time). She read it and asked if we had the form 1722. I gave her my transcripts from 2009, 2010 and 2011. On each year's transcripts, it clearly stated in bold IRS TAX RETURN TRANSCRIPTS. She took one look at the heading for each year's transcripts and said, "Ok, that's it." Another two minutes went by and she came back with the pink slip. She said her visa was approved and that we have to wait 11 business days to receive the visa in the mail. No more questions were asked. I thought for sure there would be another interview, but nope.
