Timeline

My fiancé (petitioner) has a 13 year old child from his previous marriage. They have been divorced 12years ago and the child is not under his custody and he pays her child support since then. They both agreed to have him every other weekend. Are we considered a family of 3 (including me) or we're just considered as family of two since he doesn't have the full custody of the child? If so, what will be the name of the certification we can show along with the affidavit of support? I know NOA2 is too far yet but I just want to be prepare if ever. Thank you all.

I pay child support for 4 children who live full time with their female parent. Based on research I had to declare my income based on family of six but I used partially responsible in one of the forms.

YMMV but I like to err on the side of USCIS/DOS on this journey.

You are fully responsible and fully declare any minor ( under 18 ) that you are a parent of no matter what the living arrangements of the child are at the moment unless you have given the child up for adoption or can show court papers absolving you of responsibility. You are partly responsible for any over 18 child that you are assisting with expenses/housing/schooling. In theory you could cut them off it you wanted/needed to.

This will not be over quickly. You will not enjoy this.
