ou, the American citizen, must file Form I-130, Petition for Alien Relative, for your spouse with the United States Citizenship and Immigration Services (USCIS).

USCIS will send you a receipt notice (Form I-797).You then file Form I-129F, Petition for Alien Fiancé(e), for your spouse with USCIS. If your spouse is planning to bring his/her unmarried children under 21 years of age to the United States in K-4 status, you must name the children in the I-129F petition.

If USCIS approves your I-129F, it will send the petition to National Visa Center (NVC).

After initial processing, NVC sends the I-129F petition to a U.S. embassy or consulate in the country where your marriage took place.f your marriage took place in the U.S., NVC will send the petition to the embassy or consulate in the country where your spouse will be applying for the K3 visa. This is usually the country of his/her nationality, but could be another country if there is no US embassy or consulate in that country, or there is one but the post doesn't issue visas.

After receiving the I-129F petition, the embassy or consulate will notify your spouse, with instructions regarding medical examinations, visa interview and supporting documents (proof of marriage, financial support, etc.)

Your spouse must attend the visa interview, and if all goes well, will receive K-3 visa on his/her passport.

The K-3 Visa is an old visa that they do not use anymore, these are the instructions for the K-3 but it is no longer in use! Do not follow these instructions please please please follow the instructions for the I-130

so they don't issue k3 k4 anymore? then how come they still have it on their website? i was thinking of filing I-129f coz i only filed I130 for my wife, i didnt file for my daughter, was thinking if i file i-129f my daughter could get a k4 visa even if i did not file i130 for her... but been reading things here on vj. everyones saying that i-129f is obsolete....

The provision in the LIFE Act that created the K3 visa has never been repealed, therefore, the K3 officially remains on the books. Procedural changes at USCIS (tying the two petitions together; implemented in 2006) and the NVC (administrative closure of an I-129F filed to start the K3 process when they have an approved I-130 on station) since the time the LIFE Act went into effect have rendered the K3 visa virtually unobtainable. From time to time, an I-129F will arrive at the NVC ahead of the I-130 in which case it will go forward (although the foreign beneficiary will have a choice as to which visa path they ultimately wish to pursue), however, cases of the I-129F petition filed to start the K3 process making it through the NVC are few and far between.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Hello i have been with the uscis on 2009 my ex wife she did apply for me an application I130 i did get approved but on that time she passt way so i did closed my case and in 2010 i was have another case with the uscis I 129f with my ex girl friend and also i closed it right now am married again and my wife she is pregnant so i want to know more infromation about what ill have to do thank you

Actually, when the I129F is submitted with the NOA of the I130, it goes towards the process for the K-3 spousal visa. The I129F is not just for fiance visas

please would you explain to me what's this do my wife need's latter from her friend's ? and what kind of proofe do i need to send ? 1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

Hi

I am also from Tebessa and I filed and i129f for my fiance who lives in Tebessa. The i129f is for couples who are NOT married. The i130 if for couples who are already married. You will not have to file both of them. Just ONE of them Hope that helps :)
