I really need your help, I have to say. I basically got into a fight a few years ago with two guys and wound up getting arrested for a felony assault. But I plead guilty to a misdemeanor assault, but it was against my girlfriend at the time. She basically tried to say I raped her, so it was a mess, but it was just her being vindictive. So that kind of hurt my life alot. This was about 8 years ago. Since then I have stopped hanging out with people like that and I accept I was so wrong to hit them.

Anyway, fast forward to today. I met my girlfriend online where she was trying to learn english, and I was trying to meet a japanese girl haha. This was April of 2011. I could not get a good job for over a year so we could not meet. We talked over skype and email everyday until we met, this June in 2012. I bought a hotel in May of 2012. She visited me in September, we met up in San Francisco and then traveled all over the USA for a week. I proposed to her during the trip and she met my parents.

Because of my job, I cannot get more than a week off. Because of my criminal record, I think I should not waste my time with a K1. I basically want to know if I should get a CR1, and if so, should we marry in Japan or USA. The issue is we usually need "evidence of a bonafide marriage" which is difficult to produce because we do not have shared property now. I can make a bank account and share it with her or something, but its tough if she does not have a SS number, right? Everything is in my own name because I live her alone.

The other thing I am thinking about is VWP and getting married in the USA. I know its wrong but maybe we can do it?

I just want to be with her and she wants to be with me.

Your criminal record's impact on a K1 process would be that you'll need to provide the court records. IMBRA is about informing the foreign fiancee. It is not a factor in petition approval or visa issue unless you try to conceal it by lying about it.

Why not make the life decision that is best for you regarding when and where to marry and then follow the immigration process that best fits that decision?

show pics/videos of both her and your parents at wedding party. and most importantly you have good witnesses there. instead of making her a co-owner, you can give her power of attorney for your bank account. or do it vice-versa. you must also prove communication records eg. call records etc. also show your pics/videos together throughout your relationship.

Try your best to have more visits before you get married. Evidence can include photographs that you have taken on these trips which may include family and friends. You also have your email and skype records which should help. Some banks allow you to add other signatories to your account without SSN she will have to be there to sign some papers and provide her identification. Go to your bank and check it out.

You can get married on the VWP when she visits. It would only be a problem if your intention was for her to visit, get married and then file for adjustment of status while she is in the USA. She should go back home after the wedding and you file for her. You can also choose to go to Japan and marry there.

If it was a misdemeanor is it still on your record? I don't think a misdemeanor is going to hurt you too much in this process. Whichever path you choose (and you could do any of the three) just be honest and don't omit anything the paperworks asks you. Best of luck!

USCIS will not expect a couple living apart to have items such as joint ownership of property or joint bank accounts. Evidence of marriage can be a wide range of anything such as emails, phone records, Skype records, messages exchanged, receipts from meetings in person, pictures, etc. etc.

The other thing I am thinking about is VWP and getting married in the USA. I know its wrong but maybe we can do it?

She can come here on the VWP and marry you; however, she must return to Japan when her authorized stay in the US ends.

If she comes here for a visit and THEN decides to marry and stay to adjust status, that's fine. A visitor must leave before the authorized stay has expired. A person adjusting status must stay until they have advance parole or a green card. This issue comes up at least a couple times a week. It's not as simple as many think.
