Fiance Visa Expired!!!! Somebody Help me!

If you were approved previously, then you shouldn't have any problems. I don't understand why you have such a fear of rejection this second time around. If everything is the same as before, then this petition should be approved just like the previous one.

Even with IMBRA, your US petitioner can file again (twice before a waiver is needed). This would be the second time.

Don't worry so much. Just have her file again.

If a new petition is filed, an IMBRA waiver will be REQUIRED because this would be a second petition within two years of an approved petition.

I ditto what Kathryn41 said, the only other thing I would add is to include a copy of the visa what was stamped "Without Prejudice" with the new petition and waiver application. I don't think you will have any problems at all.

Filing Limitations on K Nonimmigrant Petitioners.If you have filed two or more K-1 visa petitions at any timein the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

So yes, you need a waiver for a second petition because the first was filed within two years prior to the new petition that your fiance will be filing for you.

Simply follow the instructions: submit a written rquest with the new petition accompanied by documentation of your claim to the waiver.
