PIO Card for Pakistan born American Citizen

Hello All,

you might have come across this question many times from lot of users. But if anyone have heard or come across any experiences as such it will be very helpful:

I am an Indian Citizen living in US.Can i apply PIO for my wife who is Pakistan born American national.

Read in Travisa website that "the person applying for POI may be ineligible to apply for a PIO card if you, your spouse, parents, grandparents or great grandparents have ever held citizenship of Afghanistan, Bangladesh, Bhutan, China, Iran, Nepal, Pakistan or Sri Lanka.

the sentence says may be ineligible, which means she still stands a chance to get PIO right.. Does anyone the rate of acceptance in such situations? Has anyone got it?

05/11/2018: Mailed documents I130, I485, I131,I693, NBC for Adjustment of Status

05/16/2018: Received Date/ Priority Date - NOA Received

05/25/2018: Received NOA Bio-metrics for I485 Appt: 06/10/2018

06/10/2018: Bio-metrics are completed

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected 

09/14/2018: I131 Parole document was Approved

It says that if you are citizen of Pakistan......, you are not eligible to apply for POI card.

The decision of Approved or Not Approved will comes later if you are allowed to apply.

In your case, your wife is not allowed to apply...

In your case, your wife is not allowed to apply...

I called Travisa today and asked the same. They directed me to the PIO department.

Rep said that any person whose spouse is a citizen or former citizen of India is eligible to apply for PIO. (they don't guarantee if they grant or deny)

But yeh i feel that the rate of denial is very high!

Apply for Indian visa ( 10 yrs ), it would be easy and cheaper than PIO.

PIO will cost more, and it is just valid for 15 yrs.

they ain't giving it for more than 6months if we get visa stamped on Pakistani passport.

to stamp it on USA passport for which validity will be 10yrs they re asking for renunciation of pakistan citizenship (which according to pak embassy takes 2 to 5yrs).

Timeline

Even if you have a US passport [born USC - not even nautralized], you'll be lucky to get anything longer than 6 months on a Tourist Visa. Also, be warned that you may be waiting months for the visa to be approved...

I highly suggest going to indiamike.com and reading their Visa Forum about Pakistani-family-history based tourist visas. This will give you a good background on how similar situations have been handled.
