I need help for my situation. My husband filed his petition for me last Aug.29 and the USCIS already received it but he received an email that our case was transferred to other office. NOw, I want to know if I have option to go asap for this is emergency ,my father in law had a quadruple bypass surgery and now he is brain dead,I wanna be there for my husband as I wanna support him in this difficult time=(. We have 11 months old son and he already granted his US citizenship. Pls. anyone can help me?

If this is the case are you trying to attend a funeral. You can try to get a emergency visitor visa for that purpose.

Timeline

The child's citizenship is not a factor.

The best thing is to apply for a visitor visa. That would occur quicker than an expedited spouse visa petition.

Be sure to bring documentation from the US doctors about your father in law's condition.

I just want to share. I went to the US with my husband after our wedding here in the PH, using my tourist visa. I never had the intention of adjusting my status while in the US, but, the immigration officers gave us a hard time. My husband, myself and my mom-in-law were questioned for about an hour. They kept on asking why I am there. I repeatedly said that I am just there for a vacation and I will be coming back to the PH. The fact that I quit my job (I had an early retirement privilege which I took advantage of) made them think that I was planning on just staying there then just adjust my status, I believe. I was granted entry and was allowed to stay for 6 months. I just stayed for 3 months though and went back.

Yes, it can be done, others have done it and it is considered fraud though. That is why some, who really has no intentions of adjusting their status while in the US and using their Tourist Visa for the visit, gets a hard time at the POE...

Application is easy. You pay the fee at any BPI branch, fill-up the form online, then schedule an interview. You can do all that within the week. You have to be ready though with your supporting documents, being able to present ties to the country is the most important. The process is easy, however, gaining approval is not easy. Also, getting a tourist visa doesn't automatically mean you can enter the US. Your entry to the US will be decided upon by the immigration officer at the POE. You can either be denied or allowed...

I'm not sure how it'll go for your given that you have a pending petition. But, there's no harm in trying. All the best!

Oh, sorry, I would have to add. I already had a tourist visa years before we got married. I might have given you the idea that I got it when we got married or something, I had to clarify this...
