Filing location for I130

Hi....I need some genuine advice from experianced people...My husband is a us citizen and i stay in india . He filed I130 for me and his two stepdaughters in june. But because of some misunderstanding he sent those forms to nebraska service center directly.After we realised that it was a mistake we thought of reapplying I130 again but since june we hv neither received a rejection notice or NOA1. My concern is whn we shd cnsider that application null and void and reapply...??? If we reapply now...i mean without knowing what happened to that packet...what wil happen to our new petition...?? by the way the cheque were cashed in june for the petition which was by mistake sent to nebraska... : : :unsure:

you need to get on the phone with USCIS to see if the petition was forwarded to any of the service centers. its strange that the cheque was cash but yet, you havent heard anything :thumbs:

you sent three 1-130 and your never received a notice of auction noa-1 did you change your address, you can call the customer service number an ask 1-800 -375-5283 you also can send a e.mail to 1-130inquiries.tsc@dhs.gov you should get a reply in a couple of days.

Thanks for ur kind reply...but i think they will reject it cause we are supposed to send the application to lockbox ...we sent it at wrong location...i think u cant directly send it to service center....am i right ???

The US Citizen petitioner needs to contact USCIS find out the status of the petitions (he filed petitions, not applications). Since the check was cashed, they are likely to be in the system somewhere.

While you are correct that I-130 petitions are sent to a lockbox facility (the proper one to send it to is indicated on the I-130 instructions), sending it to the wrong facility is more likely to cause delays than an outright rejection.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
