fiance visa, why is it taking so long?

So, why the sudden and unexpected change in normal/average processing times?

When I called USCIS to inquire about the delay (which the USCIS itself recommends if/when your application runs beyond the normal/average time of 5 months) I was told the delay was due to "higher than expected numbers of applicants" overwhelming the system. I am certain this overflow is directly connected to the "executive order" issued by Obama in June of this year (Google it) which grants "children" ("children" up to 30 years old!) of illegal aliens exemption from deportation under existing immigration law. (When you call USCIS the pre-recorded message you hear even states that there is a "special" department newly established to handle all such applicants expeditously) The latest word from USCIS also indicates they are now transferring thousands of cases (as is evident from numerous recent posts here on VJ) to other offices in order to facilitate this huge influx of applicants, is it any surprise that so many legally filed cases are being unduly delayed? "Immigration Reform" my a** !

We who have filed for our loved one's to enter this country legally, and paid the required fees, and secured all of the necessary documents, and waited so very patiently, and jumped through all of the bureaucratic hoops, and literally placed our very lives at the mercy of a system which strictly dictates whether or not our chosen partners are "worthy" of admittance, are being forced to accept these conditions whether we like it or not! All for the sake of political gain!

I am april filler too, and have been waiting, I really thought mine would be aprroved in september according to timeline, oh well, 5 months passed kinda fast now we will see how long will take till I get my passport in hand and flight tickets, lol

Best advice! We did this and just kinda went about life. It was the best decision we could have made. I checked USCIS daily or every few days and chatted with my month board on here but didn't obsess. It saved us a LOT of stress!

We married on Aug 24, 2013 in a small ceremony in MA

We'll be applying for a CR1 / IR1 visa as soon as we are able

Timeline

Try and keep busy you should start preparing for your fiance's arrival. That way when your approved you are not trying to get everything done last minute. Try getting together all the requirements for the interview and empty out half your closet and dresser. Try things like that and I promise you the time will go by a lot quicker. I started repainting the house and the time has been flying by. I've got a lot of projects to keep me busy and my fiance has been doing the same and the last month has come and gone really quickly.

yeah i know, i got my fingers crossed though, seems to be moving towards april now so we will see!!

oh and i forgot to say, i didnt make a copy of the i129f that we sent away, is that a major issue? thanks!!!

USCIS Reports Vermont Service Working to Adjudicate H-1B Petitions – 10,000 Cap Petitions Remain Pending 09/19/12

USCIS has report to the American Immigration Lawyers Association that the Vermont Service Center is doing its final push to adjudicate all pending FY2013 H-1B cap petitions. The VSC expects to action (i.e. issue approvals, denials, or RFEs) all remaining H petitions for F-1 beneficiaries with cap-gap authorization before the end of September 2012. VSC estimates there are 100 pending H-1B petitions for cap-gap beneficiaries. Approximately 10,000 H-1B cap petitions also remain pending, and VSC anticipates issuing notices of approval, denial, or RFEs for each of these cases by the second week in October.

I am so stressed out, i cant sleep... i want this visa to be approved so i can have my fiance here with me, i miss him so much :( 2 of my good friends have brought their fiances last year and it took them 4-5 months they came in the US, it was so easy for them...!!

(To avoid being redundant: all of the dates for my K-1 process are right down there at the bottom of this post. We're almost 8 months in and still a month away from the beneficiary's interview, with no RFEs or other snags apart from crazy interview delays at the embassy. Who knows how long after the interview before he's here. No one said this would be easy, but it will be worth it.)
