Wait till the 60 days pass and that you are free to marry. Its better to be safe than making the whole process all over again.!!

03/08/2011 ----- RFE received and being reviewed at USCIS

03/17/2011 ----- NOA2 (I-129F approved)

03/23/2011 ----- NOA2 hard copy received

03/29/2011 ----- NVC received our Case

04/04/2011 ----- NVC letter received and case forwarded to US embassy Manila

04/08/2011 ----- US Embassy Manila received our case (Consulate)

04/15/2011 ----- Paid VISA at BPI

04/16/2011 ----- Received Eligibility Letter from US Embassy Manila dated April 8, 2011

04/25/2011 ----- 1st day of Medical

04/26/2011 ----- 2nd day of Medical (I PASSED!! Thank you Lord!!)

05/13/2011 ----- Interview (221g - Case under Administrative Processing "AP")

08/12/2011 ----- Received an email from the embassy "Case is pending review by a consular officer"

Hey there..I have a silly question but need some help. I am going through a divorce and almost finished (yay) so now me and my fiance are wondering once my divorce is finalized the law states I cannot get married till 60 days after the judges signing. So what we were wondering is if it is safe to mail in the i-129f because we know the fiance visa process will take longer than 60 days but is it okay to send in the request to get things started?

Once your Divorce is final, you can send the application immediately. Trust me, it will take much more than 60 days to get through this process. Good luck.

That leads to another question...I'm an Ohio resident, my divorce was in a Utah court, and I currently live in California. Which state law would apply for me?

the state that the divorce was filed....in this case Utah :thumbs:

I filed my K1 3 weeks after divorce was finalized with my ex - OHIO - BUT I think it depends on the State. If that's what the law says , it's better you wait for the required time to be on the safe side
