I am in the process of filling out the I-129F petition for my British fiancé. After browsing the website I have noticed many of you are instructing people to provide evidence of U.S. citizenship, that we have been in the same place within the last two years and if necessary previous divorce papers. I was just wondering if you could be kind enough to direct me to the official USCIS website where it gives instructions on what to include. I just can’t see where it says you need to include evidence at this very early stage of the visa process. Thank you in advance for all your assistance.

When it comes to the I-129F petition, there are three things you need to prove:

  • US citizenship for the petitioner
  • Intent to marry (and be legally able to do so)
  • Proof of having met in person in the last 2 years

I suggest taking a look at the I-129F instructions that are provided from USCIS:

It lists everything that is required for your petition. So it's not just this forum that instructs people to provide such things, it's USCIS themselves. :)

Thank you for the help. I am just a little suprised you need to send eveidence so early on in the process.

The evidence you send to file the petition is to prove that you comply with their requirements.

The I-129F petition is basically asking USCIS for permission to file for the visa. USCIS wants to make sure you're legally eligible and meet the requirements of the visa before granting you that permission. Evidence is necessary.

If you are still confused, both of you read the instructions and guides on VJ also read them directly on USCIS. That keeps both of you informed and in the loop.
