Fiance is 23--do we need to notarize or even have parent consent?

I'm in the US, and my fiance is 23. I downloaded the parent approval/consent form, because in Philippine law she is under 25 and needs parent consent/approval. However, since we're planning on marrying in the US, is this even necessary? And does she need to get it notarized? Could we get it signed, but not notarized, or will that mean a delay?

I'm so new at this. . . what is CFO? I thought there would be a link to terminology here, but I can't find it.

Should I get the parent signature notarized? Where does one get that in the Phils? In the US it's easy (bank, etc.).

here is the link http://www.cfo.gov.ph/ she need to attend that once she got her visa before flying to u.s or even do it in advance and just go back there when she got her visa and yeah notarized with parents signature., i don't think it is needed for interview tho., just for cfo seminar. goodluck

Or do you mean it's for the interview, but not for the initial petition?

oh nah you don't need that for initial petition nor to the interview day but only for CFO Seminar here in Philippines that your fiancee need to attend

I think the parent consent only applies if you marry her in the Philippines... you would then be under the Philippines laws of marriage.. but you’re going to marry her in the United States. Hmmm... but I'm not sure.

That's what I was initially thinking, and I'm glad to get some clarification. Just wanting to make sure I get all the paperwork taken care of with few delays.

yeah they don't mentioned it there.. but if u search about cfo requirements here in vj or review about attending cfo.. they will ask you to have parental consent/advice., but like i said for initial petition u dont need that i dont remember submitting that when we send out petition.

It doesn't say many things the CFO has been known to ask for, you should take it there with you.

Parental consent is parental consent, it doesn't matter where you're getting married.

It does need to be notarized.

It's not necessary for the I-129 but family letters are a great thing to front load with.

Parental consent is not required for any marriage in the US who's 19 and over, just show some ID or driver license. If you're planning to get married in the US which I'm assuming in HI, here are the requirements to obtain marriage license.

Who is Eligible to Apply for a Marriage License?

There are no state residence or U.S. citizenship requirements.

Blood tests are not required.

The legal age to marry is 18 years for both males and females.

Males or females of 16 or 17 years of age who wish to marry require the written consent of both parents, legal guardian, or the family court. The parents or legal guardian do not have to be residents of the state. Consent forms may be obtained from a marriage license agent.

Males or females of 15 years of age who wish to marry require the written consent of both parents or legal guardian, and the written approval of a judge of the family court. The parents or legal guardian do not have to be residents of the state. Consent forms may be obtained from a marriage license agent.

Proof of age is required. A certified copy of a birth certificate must be presented for anyone 18 years of age or under. A valid I.D. or driver’s license may be presented for anyone 19 years of age or over.

If previously married, proof of original divorce decree or death certificate needs to be presented to the marriage agent by the applicant if the divorce or death was final within 30 days of applying for a marriage license.

Cousins may marry. However, the blood relationship between the prospective bride and groom cannot be closer than first cousins.

How to Apply for a Marriage License

The prospective bride and groom must appear together in person before a marriage license agent to apply for a marriage license. Proxies are not allowed.

The prospective bride and groom should be prepared to provide the necessary proof of age and present any required written consents and approvals. All of the necessary documents should be obtained prior to applying for a marriage license.

The prospective bride and groom must prepare an official application and file the application in person with the marriage license agent. The application may be completed online (see website below). The application will not be accepted if sent by either postal mail or e-mail.

Upon approval, a marriage license is issued at the time the application is made.

The marriage license fee is $60.00 (plus $5.00 portal administrative cost). The fee may be paid online or in-person at the time the application is submitted to a marriage license agent.

The marriage license is good only in, but is valid throughout, the State of Hawaii.

The marriage license expires 30 days from and including the date of issuance, after which it automatically becomes null and void.
