Hey everyone, my name is Ayo and I'm new to VJ. I have learnt alot from this site and I must commend moderators and members. I have a question that has been bugging my mind for a while now and I feel i can get a quick response here.

I met my girl friend on an online dating site close to a year ago and we have been friends since then, I travelled to tampa to see her in april of this year and we just connected more, I also went to see her in May and asked her dad if it was ok to date her. In july i summoned courage to ask her to marry me and which she agreed to do and I gave her the "promise ring". When all thsi was going on, we have always been talking about marriage and relocation. Initially i didn't dig the idea of marriage and relocation, but when I spoke to my employers, they told me that if I can get my "papers" i can be transfered to work in the company's office in the US (i work for an airline in the US).

Now my fiancee, her parents, my parents and myself have all agreed that we should have a wedding in May of next year, this is my question, is it adviseable we take the K1 route or the K3 route. also if we take the k1 route, when is the best time to start the application process, bearing in mind that the wedding is coming up in may of next year.

I would like anyone who has meaningful information to please let us know

Only thing that jumped out at me is to not plan any wedding date until after the K1 (if you go that route) has been approved.

thanks everyone,

well we intend to get married in the US, we wanted to get married where both parents would be present, my parents are younger but her's are way older so the informed our choice of the US. Also, I just have a guts feeling if we start on time, the approval might be gotten before the wedding in may!

It could be approved(K-1) by then but it depends on a number of factors that occur/could occur along the way. Not to mention processing times at the two visa centers can change at any time. Vermont is processing quite slow at the moment, but it could pick up suddenly and then California slow down and you could be stuck in that queue(if your application went to cali that is[depends where you live where it goes]). Not to mention if you got an RFE then that could put the process off for another month or so. Many things could happen.

Also if your fiancee is from a high-risk country then the processing might be a bit slower at her embassy when it gets to the point after the NOA2.

Do NOT make any plans for a wedding date, it can't be guaranteed at all that you will be approved by then. The USCIS doesn't recommend you do this until after you have your visa in hand. If I was you and you wanted a wedding at some point mid next year, I would be filing your K-1 in the next week or so and hope for a quick processing. You might not get approved by May but it could be close to it at least :thumbs:

thanks alot hey sofia, but I have my tourist visa, if the k1 visa is not approved before the wedding, can i just go ahead with the wedding and change the status of my visa to an IR/CR visa??

You'll have to start all over again with new forms and new fees

If you are set on a may wedding, wait and do the Cr-1 visa after you are married

Hey guys, after reading through various post, i just have a tought i don't know if it is realistic and feasible, since we have chosen the date of the wedding, why don't we go ahead with the ceremony regardless of if the K1 visa goes through, and when the K1 visa goes through, we can just go back and have a court house signing of the marriage register which makes the marriage legal. Is that a feasible thing to do, as the date of the wedding is fixed.

Because a K1 visa is for people who are SINGLE. The moment you get married, you stop being single; therefore your wife will have to file a petition for an spousal visa and drop the K1. If you lie to the consulate, and keep playing it as if you hadn't gotten married, you'll be committing visa fraud.

By the wayt, K3 visas are obsolete and they get processes as CR1.

^^^^^^ What Celeste said. If you want you could book the wedding for May, she can go to the USA to get married on the day then leave again and file the CR1-Spousal Visa. Only issue you would have is that the Custom Officer(CO) at the airport may find the situation too suspicious and deny her entry.

But yeaaaaa...no, K-1 visa is for single people PLANNING to get married. You cannot marry and then file a K-1, you will get denied and told to file a CR1 visa.

well she is the one in the US, i'm in africa...i have a B1/B2 visa and i have been to the US over 18times in 14months, training and all................so can't i just go get married to her and come back to africa and apply for a CR/IR visa?????
