Hello,

I just have these 3 questions:

1) When does your K1 VISA start counting down? Do we go by when it was issued or the date that is stamped on the I-94, which is the date of arrival to the United States?

2) What are the fees involved for applying for the "adjustment of status" for the Green Card?

3) When we do file for the Green Card, how much time will they give us to stay in the United States while awaiting the decision?

1. There is no "count down" so start whenever you want. Most people who perform an artificial count down start with the date of the receipt notice. There is no requirement for USCIS to produce anything within any certain period of time, hence there is no "count down"

2. Currently $1040 for one person. Can and has changed and may change before you file. You will pay whatever the fee is at the time you file, so figure on around $1000-1100 for one person

3. Indefinitely.

1. There is no "count down" so start whenever you want. Most people who perform an artificial count down start with the date of the receipt notice. There is no requirement for USCIS to produce anything within any certain period of time, hence there is no "count down"

2. Currently $1040 for one person. Can and has changed and may change before you file. You will pay whatever the fee is at the time you file, so figure on around $1000-1100 for one person

3. Indefinitely.

I'll correct #1 above (based on what I've read) by saying that: USUALLY (or so I've seen claimed on this site, ask the embassy to be clear) K-1 VISA itself is valid for 6 months... That is, you have 6 months after the Visa is issued to you by the embassy/consulate, in order to enter the US.

If you're asking about the 90-day countdown for marrying once arriving on K1 visa, the 90-day countdown start from the date that is stamped on the I-94 (which is the date of your arrival to the US). You have to marry your fiancee within this 90-days.

The visa must be used to enter the United States within 6 months of when it is issued. You must get married within the 90 day period of the I-94 in order to be able to file for AOS as a K-1. There is no particular deadline to file AOS.

Isn't it based on medical approval and not interview approval/visa issue date? I've heard of people getting a lot less than 6 months validity after a problem with the medical and it being based on that date

Correction: It is currently $1,070.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...
