MEMBERS OF VJ, I HAVE I QUICK QUESTION, CAN I FILE FOR MY WIFE WITH HER MAIDEN NAME SINCE THAT IS WHAT SHE GOT ON THE PASSPORT. WE DO HAVE OUR MARRIGE CERT. IF SO, HOW DO I GO ABOUT THE IT LIKE, FAMILY NAME, ALL OTHER NAMES USED. THANKS IN ADVANCE FOR YOUR INPUTS

Caps off - it means you are shouting.

You can file with whichever name she has in her passport but do know that if she is taking your name but keeps her maiden name in the passport, the visa and the green card will be issued with the maiden name. Then you'd have to file I-90 and pay the fees to get it changed to married name.

Now, you can file with her married name I-130 petition and in the meantime she can get her passport changed to the married name - that will get you the visa and green card in the married name.
