Applying or K-1 for Brazilian fiance

Timeline

Hey all,

My girlfriend and I are planning on getting married sometime in January. We are now looking at getting married in the US rather than Brasil.

Originally, we planned on marrying in Brasil in January, and waiting for her CR-1 to process. However, it seems the K-1 may be faster and easier.

If I am to apply for her K-1 now, could I still go to Brazil sometime in December, and then we both can come back together once her K-1 is processed?

Also, does anyone have a time estimate on a K-1 visa? Or which service center it is sent to, I've heard Vermont and California. Are the K-1 fees similar to that of a K-3/CR-1?

You as the US citizen can do whatever you want assuming you have a visa to stay in Brazil. K-1 takes between 6-9 months. You send it to a lockbox in Texas, they will forward it on. I don't mean to burst your bubble but I don't think you will have your fiance here by January to get married. The K-1 visa takes about 6-8 months to approve and then when your fiance gets here she has to wait and adjust her status that usually takes 90 days. She cannot work or leave the country until she adjusts her status and receives her work authorization and green card. You should compare the fiance and marriage visa carefully on this site. The marriage visa takes usually 2 months more (at least that is what I've been told) but your fiance comes in and has her work authorization and green card immediately. You should review to see what is best for you and your fiance. I was given inaccurate information at USCIS and that is why I took the K-1 if I knew about vj before I woul've done the marriage visa. You should compare them to check. But either way a US wedding in January is most likely not going to happen.

If you look at Que Saudade's timeline you will see they sent out the petition in September but didn't have their interview until May. You should expect your petition to be about the same if you send your petition out immediately.
