Update:

I have arranged to visit earlier! I will be visiting her for christmas!

question: Should I file this year or next year?

question: What can I do to quicken the process? I will be with my fiance in person, so should cut down on mailing times. I can also get someone to help me with the process back here in america eg: print photos and submit.

You should file immediately AFTER you return from your trip to visit I would think. During your time together, you can gather documentation that you met, take photos, fill out the I-129F, etc. If you have it all prepared and signed, then you can drop it in the mail as soon as you return to America. That's what I did anyway.

well the difference is that I will be filing 2007 instead of 2006, since I will come back after new years.

I'm afraid of any law changes that may incur.

You can't worry about law changes. They could happen at any time. IMBRA took effect in March, for example.

If you file ahead of time, they'll take that date and all the evidence two years prior into consideration. In other words, it won't matter that you're going to see her on Dec. 23 if in the paper work you send in on the 18th says 'we haven't met in the past two years.' So you need to meet before you file.

But here's what you can do. You can fill out the I-129F, gather all your supporting documents, fill out your own G325-A, sign your own letter of intent. When you're there, get the passport photos from her, her G325A (all four pages signed), and her letter of intent statement (signed). Them once you get back in January, compile the packet, send it off, and away you go.

Still might not make your August date, but you'll have a better chance the earlier you get it in.

You can get your case possibly done in 9 months but if you file in Jan 07, you still will not make an August wedding date (that's only 8 months anyhow).

So what happens if there is a new law and there are extra delays? What happens if it's 1 year?

I don't understand. Jan-Aug is 8 months.

well the difference is that I will be filing 2007 instead of 2006, since I will come back after new years.

Law changes are a concern but if there was another potential wholesale cluster such as IMBRA on the horizon one would think we would already hear inklings as such by now because it would be running through congress. The potential attachement of IMBRA to VAWA was a known fact way before Bush signed it into law on January 5, 2006. Eventhough we knew of it the problem was that no one believed congress would do it and then to make matters worse, the USCIS completely screwed up the implementation.

yeah I'm being a little impulsive; I had the impression that immigration would be very fast, and had no idea till I started reading these threads. The last time I seen my fiance, we were still finding our careers... I found my stride in life, and things have changed. we've been more serious and I put off the immigration issue, thinking it would be easy...

I had no clue.

wedding on early september *should* be doable. The main intent of the february visit is so that I can spend time with her during *tet*, it's a vietnamese holiday. I figure I cant have it both ways, and I must give something up. Most important would be the late august/early september wedding date. if that absolutely must change, then I will have the wedding without my family (worst case scenario).

Rather than worry about visa deadlines, you could just apply for the fiance visa (after your december meeting), bring her here, get married, file the AOS (adjustment of status) and related paperwork. Then when you get AP (advanced parole) or her greencard, you can both go back and throw a fabulous wedding party.

Rather than worry about visa deadlines, you could just apply for the fiance visa (after your december meeting), bring her here, get married, file the AOS (adjustment of status) and related paperwork. Then when you get AP (advanced parole) or her greencard, you can both go back and throw a fabulous wedding party.

this would be great, but I really cant afford an extra trip like that. it's an option, but I'de like to keep it my last option.

I think you'll find that it's actually the way most people handle a wedding in the home country. If they want to file a K1, that is.
