I-134 income requirements

Hello,

My fiancee and I filed the I-129f package in July and are getting prepared for the next steps. I am the sponsor and my question is about form I-134. I am self employed and in 2011 my incone was $2400 but in 2012 I am already over 100k so if they check 2011 tax returns i will be below requirements. If i provide bank statements for 2012 will it be sufficent?

Provide bank statements and a letter from you current job station your job description, how long you have worked there and how much you make. Also send several of your recent pay stubs. Of course you don't need to send the I-134 until after your NOA2 is approved which will take over 6 months at the VSC. But it is good to get familiar with the I-134 now so that you are ready when time comes to submit it.

For a self employed person the income amount used is from line 22 of the most recent form 1040. Gross receipts/earnings during the current year are not the same as income.

You can amend your 2011 tax return, reduce deductions and show an income that meets the requirement. There may be additional tax due. If you believe that line 22 of your 2012 return will be above the requirement, then make sure that you and your accountant get things filed asap in January and submit that return when the interview is scheduled.

the amount of line 22 in 2011 is $2400

net income for 2012 is over 100k, gross is well over that amount.

For a self employed person it is the most recent year's tax return. From what you describe you will want to use your 2012 form 1040.
