I have a couple of questions relating to the K-1 Visa application regarding my case, we haven't filled the application yet, but I wanted to ask these anyway.

First, my Fiance just started working again, she had to quit her job because of medical reasons last year, would that greatly affect the application? Her annual salary at her current workplace should be just over the required minimum.

Second, we were thinking of asking my uncle to sponsor, just to be sure, to feel more comfortable about the application, and as far as I know it would cover the minimum as well, would there be any problems here?

And last, what sort of assets can I produce to help with the application process?

Thank you!

1. If your fiance is the beneficiary, it doesn't mater at all. If she is the petitioenr, she will have 6+ months worth of paystubs by the time of the interview, when you need to present the I-134, so again it should not matter.

2. That could be a problem. USEM usually does not accept co-sponsors for fiance visas.

3. Assets must be easily liquidated within a year without undue hardship. So a savings account is good, a second home or car. A primary home or 401 is less good. Assets usually have to be US base,d but it depends on the embassy.

Just wanted to add that a 401(k) or IRA is a pretty liquid investment. Just deduct from the balance your taxes, and a 10% penalty if you haven't reached 59 1/2. I would say go ahead and use the asset if you have it. Good Luck!

Are you the beneficiary or petitioner?

I am the beneficiary.

1. She is the petitioner, and I'm glad to know.

2. Will it be negative towards us if we have my uncle sign the form and produce all his stuff just in case?

3. Okay, good, thank you.

Thanks to both of you!

If your uncle is a USC or LPR, he can fill out an I-134, provide supporting documents and be your fiancee's co-sponsor. However, Manila does not usually accept co-sponsors and it sounds like one will not be needed if your fiancee makes the 125% requirement for her household size plus you. Current income is what is most important.
