hello VJ's user...!!!

I need some advice or any ideas from you guys coz until now i can't sleep and it keeps bothering me.. We got our NOA2 July 20, 2012, and we already have our MNL#..

My problem is when my fiancee filing K1 he send his 2008,2009,2010 W2 and ITR, and then we was now on disability leaved for a year and his 2011 W2 is below from the income they required but for the prev year he earned much above the required income.He has no savings he only have his house as an asset.

My question is:

1.) Is our petition will be affected?

2.) Would it be the reason that i will be denied?

3.) Should they'll ask the 2011 W2?

Why did he not send the 2011 W2? Is he still on disability?

It doesn't matter when you filed K1. It matters when you receive your NOA2. He should include his 2011 for your Manila packet due to 2011 taxes being completed. Those that may not be questioned as much during interviews about last years taxes is someone with interview date of January. Regardless they will still want check stubs and bank statements as close to interview date as possible. Don't leave out anything that will cause you to walk away from the interiew window unhappy due to needing required documents for approval. Amend your packet if need be. Good luck.

Bigbear!!!... is it too late for us to get a co sponsor?..but he will go back to work this Nov.

Welcome to the forum.

From what I have read, I don't believe that MNL allows co-sponsors for K-1 visa. Has that changed? Check with the PHIL regional forum.

Philippines does not approve many co-sponsors. He has a job to go to when he comes off disablity and can prove this in a letter? If so then you will be okay AS LONG as the disability monthly equals roughly $20,000 yearly when you go to the interiew. So if he earns roughly $1600 a month now on disablity then you will okay to meet the 125% poverty level to be accepted. I would not try co-sponsors as from what I have read Manila approves few applications with co-sponsors. I don't know why but they are more strict but they are. Or if your fiancee has $60,000 in assets you will be okay as well. My suggestion is if his disability is not $1600 monthly then I would wait to finish everything when he is released to return to work. Look at it this way. You are only two full months now until November 1st as August is almost over. You have come this far. Don't chance a delay if you do not meet the minimum now or have the assets. If you do the minimum with his disability then make sure you have an employment letter when you go to the interview.

None of this has any bearing on a petition.

For a visa, disability counts as income and would be added to any other income he made that year. State total income from work and disability, attach w-2s and proof of disability payments. Sleep well.

If his income plus disability is more than the guidelines then do not worry

YES!!! i have a letter from the company that he is on disability but they did not put on the letter how much his salary is it ok? he got almost 2000 dollars on his disability every month and he has 3 children ages 10,6,6..but on his 2011 W2 its not showing the amount he got from disability coz he said its from social security and free of tax..and i have no proof to show them that he got that amount evry month even though his on disability.. his asset is more than 60,000 dollars plus life insurance..

You're most welcome. It looks good for you. Normally the $2000 monthly disabilty will be more than enough but you mentioned he has 3 children as dependents. This now moves you to $32,000 a year so his monthly disability is not going to be good enough. However you said his assets are 60k or above then now you're okay again :D
