No NOA 1 after 25 days =(

Hi everyone... Maybe someone asked about the same thing already...but I couldn't find the topic so I thought someone would be kind enough to explain about it again.

We sent our I-129F around August 26th, but it was returned to us on September 17th, 2006 by VSC because they said the forms were expired.. eh... so on September 27, 2006 we sent new I-129F along with the other paperworks... but until now we have not gotten our first NOA. My fiance called the customer service center and actually talk to a human there (finally) and she said she will call him back. She also asked for his e-mail address but.... it has been 5 days now (almost 6) and we have not gotten any feedback. What is going on? =( Is it normal that we don't get the first NOA until this long? I have seen that everybody else got it fast...

It is difficult to say for sure, Vermont is not unknown to process through complete to NOA2 in your time frame. But hang in there. Has his check been cashed? If so, your application is there someplace, and perhaps you will get both NOA1 and NOA2 at about the same time.

So I've asked my fiance, and turned out that his check hasn't been cashed yet... something is definitely wrong. He got kinda angry and he said that he's going to AGAIN re-send everything on Monday... O my God, we've been wasting 2 months.......now we have to wait for another month...this isn't fair.

Was it sent using tracking i.e. Federal Express, UPS, etc? If so, you will know it was received because it would have been signed for and you can view that online. Sometimes it takes weeks for the NOA1 to be sent but if the check has not yet been cashed, you might as well start over. This time, use Fed Ex. If he sends it Monday, it's not gonna take another month for the NOA1, but not a bad idea to get comfortable with the idea of delays (see my timeline) as it can happen to anyone, at any point - service center, NVC, consulate.

Um... by the way... my fiance kept copies of the whole thing.... would it be okay if we just send the copies this time? What about my signatures? Cuz if he has to send the document to me and me send it back to him after signing it...it'll take ages..... Would the INS accept the copies with a letter saying that we already sent the genuine documents before but did not get any feedback?

You need original signatures - not copies. You can download the G25-A form, fill them out (4 copies total), sign each one and Fed Ex to him to save time.

Are you 100% sure it has not been received? What method did he use to send it?

What does NAVY MPS mean?

He CANNOT sign for you - that's forgery!

I thought so. But I also thought if he does it with my permission then it's not forging.... haih...... I guess I gotta do this all over again...... should forget about sending it in Monday.

Seems like, unfortunately, the Military Postal Service did not perform their job very well.

Assuming the check has NOT been cashed, your best plan of action at this point:

1. You fill out the G-325A forms online, print and sign 4 copies and Fed Ex to him.

2. He resends the entirely same package, aside from your brand new G-325A forms, using Fed Ex or UPS. 3. Make sure he makes one more copy of the entire packet for future reference.

He might also want to stop payment on the previous check if it doesn't cost him a fortune.

I thought I'd add my two cents since I am stationed in the Navy overseas. MPS is the same as USPS I don't know where your fiance is stationed, but if he didn't use Express or Priority Mail for the petition, it more than likely was shipped Space Available. If this is the case, unfortunately you'll have to wait a little bit longer, because this means the mail was shipped on planes that have extra space to accomodate mail. Where is he stationed??

He's stationed in Norfolk, on USS San Jacinto. He said he used the priority mail tho... =/
