New Birth Certificate question (and other questions)

Hi All!

I'm fairly new here and my fiance and I are going to embark on the famous(or not so) K-1 visa.

Question 1:

Having read somewhere in this thread, we can change our birth cert to a new format (is it this one? Extract of Birth Certificate) and would never have to worry about getting it translated AND certified anymore? And it's internationally auto-certified? Is that true? I mean if it's true then it's one less thing to worry!

Question 2:

Once you have the visa in hand and enter the US, do you have to proceed with a civil marriage or is religious marriage acceptable? I've read somewhere in their Islamic Center's website and they still require government issued ID and we need to fill out an application form (meaning they will register our marriage - but whether it's valid for all US Government's usage is unknown)

My fiance lives in North Carolina, if this helps.

Question 3:

Once we get married in the US, do we have to register our marriage to the Malaysian embassy in Washington? We are planning to come back to Malaysia for a wedding ceremony with the family and I was thinking we could register our marriage all together (though I'm pretty sure we'll be fined RM2000 for marrying outside of the country)

Question 4:

I'm going to the US in 2 months time (Oct 2012) to help him filling our I-129F petition. This will be our 1st meet-up (last seeing each other was 3yrs ago)

  • Can I start applying for Citizen of Good Conduct cert since it's taking about 2 month to receive it?

I know it's kinda early but reading all these posts are making me paranoid!

Don't know the answers for sure for your questions except 3: you do NOT get fined for marrying outside Malaysia! ahaha

Answer 1: If you have the new birth certificate with English, you don't need another English translation.

Answer 2: Once you entered United States with K-1 visa, you will have 90 days to get married (meaning you both will need to register with the court and have the marriage certificate)

Answer 3: I never heard that your government will fine you for not get married in Malaysia.

Answer 4: How do you qualify for K-1 visa if you both never met in person within last 2 years? Has your I-129F approved yet?

hi Alia, a lil guide I found here pertaining to getting new birth certs.

The birth cert is bilingual so there's no need for you to get it translated anymore.

Also, since you're going to the US in october, maybe you guys can just get married there, come back to Malaysia and file for the CR1 instead. Then do the religious ceremony after that in Malaysia.

Or are you going there to get married in Oct?

I suppose we have to go for a civil marriage rather than a religious one since K-1 visa only accepts civil marriage...

As for your question 4, it has been 3 years since we last saw each other in person, but I'm going there to see him so we can fulfill that requirement. In fact, my flight leaves tomorrow! :) We haven't filed I-129F yet, but we're going to as soon as I land there

Wow, thank you so much for the link! That clears everything up about the new birth cert format!

I have thought of that (getting married there and applying for a CR1 instead) but it just seems a bit more tedious than K-1..I dunno, probably it's just me.

Timeline

a friend of mine did the K1 way but turned out it was as long as my I-130.

Both have its own pros and cons so might be a good idea to check before doing it. The K1 is supposed to be the shorter route but with the way things are these days (politically), we can never know.
