Timeline

Just mailed off my application today, so now to sit back and wait for the NOA1 and hope that we didn't do anything wrong. We spent ages yesterday checking and re-checking the mailing address, making sure we had included everything, and that the check was clearly written, dated and signed. Hopefully this'll be a simple process.

We just mailed our package today by USPS Express Mail today. I hope everything goes smoothly without problems. Below are what we sent in. I am not sure it will be enough...

Hi. I'm wondering if anyone here can give me some insights:

I'm trying to file RoC by August 24th, with the waiver for divorce, with the intent to send the decree in response to a request for evidence. I've been separated from my wife since late April, but because of unexpected obligations with work, she's taken a long time in sending me the documents she promised to send, and the hassle over that and other things have prevented me from being well-prepared in time.

I'm receiving my documents only on the 22nd, and could still scramble to send them in in time. While making the deadline seems preferable, from what I've read on the forums, it doesn't seem like a few days late would be a real problem in practice, particularly given that I have a good explanation why it wasn't my fault. I'm not 100% sure though?

Also, I'm confused by some things it says in the instructions for the I-751. It seems to say affidavits are necessary, while on the internet I've mostly read that affidavits are only necessary if you don't have other documentation.

And under when to file (for the waiver case), it says the following:

"You may file this petition at any time after you are granted conditional resident status and before you are removed."

So does that mean that although removal proceedings theoretically start at the second anniversary, if you send it later than that, they can't fault you as long as you haven't actually been deported? Or does it only mean I could have sent it in before the 90-day window? I'm confused.

I've been trying to consult a lawyer about these things, but in the mean time, I'd greatly appreciate any answers people may have.

Why put yourself in the position to have to ask for a waiver? It seems crazy to me. I would file on time with whatever I had at the time and pay the fee. Then wait for a possible RFE. It's a much better "problem" than not filing on time!!

Send it overnight with tracking you you can prove you filed on time. I used USPS overnight since FedEx and UPS cannot deliver to a PO Box.

Thanks. To be clear, the waiver is the one where the marriage ended through divorce. My divorce isn't final yet, but will be in a few months. My understanding, based on the memo here (http://www.uscis.gov/USCIS/Laws/Memoranda/Static_Files_Memoranda/2009/i-751_Filed_%20Prior_Termination_3apr09.pdf) had been that I should file with a request for a waiver of the joint filing requirement, but without sending the divorce decree until the RFE (since I don't have the decree yet). Did I get confused?

I don't have a good idea of how I should be trading off making a hasty submission vs. being a few days late. If I'm going to have to send in the divorce decree later anyway, does that mean I'll have an opportunity to send more evidence of bona fides later regardless? Or is there a risk that they'll just reject it?

Also, thanks for the USPS overnight tip. I guess there isn't an alternative address (for California) that I could FedEx/UPS the package to, that isn't a PO Box?

Do they need to have it the day before the 2 year anniversary, or is it good enough if they receive it on the day of the 2 year anniversary itself?

I really believe you are making a huge mistake not filing on time and something you are going to regret. I hope I'm wrong for your sake.

Getting something in on the 24th, which is the deadline day, would still be feasible. (That is, sending it the 23rd and it gets there the 24th. This is what I currently intend to do.) Do you think that would itself be too late? Getting something in on the 23rd would probably not be feasible.

Have there been any known cases of people getting their application in on the deadline day, or even say 1-3 days after, and getting rejected on that basis? Particularly if it happened because of reasons beyond their own control?

So, your GC expires on Aug 24th?

We sent our packages to CSC. It seems take a long time to get news now than 2010. Last time I checked at 2010 right after I received my 2 YR GC and it only takes 2 months to approve the 10 yr gc.

I think if they receive on the 24th, you are fine...
