Hello!

I really hope someone reads this message and tries to help me with an answer because I really don't know who else to ask anymore.

My fiance and I applied for a K-1 visa and got an e-mail on February 22 that our visa is currently at its initial review. So my fiance visited for over 2 months and we called his congressman and she sent us a letter and called to tell us to reach her secretary on july 30th if it takes more then 5 months for the NOA1. Useless to say that we didn't get the NOA1 yet so we started worrying(as usual) and my fiance called the secretary last week.She told him she would look into it and call him back but she didn't so this week he called again and she didn't even remember they spoke already. She was very bitter and told my fiance that he should look on USCIS's website and see that for texas service center(that's where we sent our documents)it takes 15 months to process the case. We panicked and we really don't know what to do next because right now our lives are on hold. We want to be together and we don't know which decision we should take because we don't want to complicate things. So my question would be, is it really posible for a NOA1 to take up to 15 months? We have already waited for 5 and no change in our case and my fiance is preparing for med-school and he is struggling with everything. He doesn't know if he should come and live in Romania with me or stay and wait patiently for 10 months without seeing me. It's very expensive to buy a plane ticket and travel back and forth over and over again when we should save up for our life together. Some friends told me to get a lawyer to look into everything but I really don't know how much would that help.

You did not send your documents to the Texas Service Center. You sent it to the Texas Lockbox, which will send it on to a service center (California or Vermont).

Texas doesn't process K1, that is done in Califronia and at Vermont. Where did it say on your NOA1 that it was sent to?

Did you register on the USCIS website for updates? I think you should start by engaging USCIS first before your Senator.

First, the petition is not at the Texas Service Center. It was, hopefully, sent to the Dallas Lockbox, which is not the same as the TSC. From there, the petitioner would have received a letter stating which service center would adjudicate the case -- EAC (Vermont) or WAC (California). Check which service center has the petition. If it's been 5 months, you're still within the standard processing time, however.

I think you might have a few things confused, lets go step by step.

Your fiance mailed the petition on February and received an email confirming the petition was accepted and you are on Initial Review, correct? If this is the case, you have already received NOA1, because this first notification is the one that tells you that they've received your petition and they assign a Receipt Number that could start with EAC (being handled by the Vermont Service Center) or WAC (being handled by the California Service Center). The Texas Service Center does not process K1 petitions. The petitions are initially sent to a sorting facility in Texas, but they re route them to Vermont or California...

If you have, in fact received NOA1, then you should be about to recieve NOA2 with the approval notice.. and YES! That one can take 5+ months depending on which Service Center is handling it, because they are a little backlogged at this very moment.

So, can you check if any of the above things happened? As long as you see which Service Center is handling your petition, you can modify your profile and add the correct one; because Texas Service Center is incorrect, and you should create a Timeline http://www.visajourney.com/forums/topic/102797-create-a-vj-timeline-to-track-your-case-and-get-estimated-approval-dates/ and insert the NOA1 date.. that will give you an estimated date on which your NOA2 may be adjudicated.. BUT you need to change the service center, otherwise the date will be way off.

Thank you guys! I know my post it's probably silly but I really don't know who else to ask. Yes, they sent it to vermont service center. And we called our congressman because we know her and we thought we could get some answers.

It was not silly, you were just confused.

Ok, so.. first step. Edit your profile and change Texas Service Center to Vermont Service Center .. step 2: create your timeline to get an estimated date.

Vermont is WAY backlogged and it will, most likely, it'll take a little longer than usual.

I was freaking out about it because I saw many people saying that they got their NOA2 in 90 days or 100 and and I didn't get anything. I am thankful there are people like you that went through it and can clear my confusion.

Completely understandable. The people that you see getting NOA2 within 90 to 100 or some days lately, have their petitions being processed by California; which seems to be more up to date.

the good news is that it probably won't take the whole 15 months for you to hear from VSC.. the bad news is that well, you case IS in VSC - and those guys were running really behind since the end of June. My NOA1 is Feb 11th, and we got our NOA2 on July 25th. I have seen cases that were approved with much later NOA1, but on the other hand cases from January are still being approved too. So, it varies as you see. Just don't stress out, it's coming, and it's coming soon!

So I guess the petitions are randomly picked? I didn't know that the receipt number tells you which is the service center you applied to(silly me)and Chris new nothing either. I hope I'll be better prepared next time when someone will need my help. I am not worried that I have to wait a lil longer. I was stressed that it might take us 15 months. I'm just sorry that I complained so much of not being able to be together and Chris grew weary and sad.
