Soooooooooo, I try to stay ahead of the game. Try, being the keyword here. My questions pertain to the time limit, the options, and limitations of obtaining a job once my fiance is approved,we are married and have filed for adjustment. And yes I make way above the poverty level for two people. No problem there, but I do work alot and well he is going to get stir crazy. He will need to do something every day.

~So is it at all probable for him to be applying to US companies now before he gets here? Will that hinder the process in any way?

~When AOS filed, is there a time limit to which he can work? Amount of hours, salaries, IF he can at all?

~What needs to be filed to obtain a work visa/permit? ETC.........

Thanks for any advice in this deparment.

AS of now, no we have not been approved, still waiting.

1. No it won't hinder but he won't be able to work until about 3 months after he's filed AOS and most places won't wait that long

2. No limitations as long as he he has an EAD and SSN

3. He needs to wait for the EAD (work permit) as long as he files the paperwork for it (I-765) and that taes about 60-90 days to approve

Assume 90 days after filing whether employers would take his applications seriously is another issue.

He should apply for his SSN about 10-14 days after entering the US with his K-1: http://www.visajourney.com/content/ssn

Then after you are married, he files for AOS and will be sending the form to apply for the EAD(employment authorization document) along with the other forms for adjusting status. He should plan to do work around the house or take up a hobby for the first few months. It takes around 3 months to receive the EAD after filing for AOS: http://www.visajourney.com/content/k1k3aos

Once he has an SSN and his EAD or green card, he can work in the US just like anyone else. No restrictions, other than he can't apply for jobs that require US citizenship.

Hello everybody! I had the same question. But now, I wonder what is the benefit of asking for a SSN if anyways the fiancee needs the EAD to get a job? And also, Does he/she need to change the name in the SSN after the marriage?

The SSN can be needed for bank accounts, adding to insurance plans, and things of that nature. Plus, they will need the SSN and EAD both to begin working. It is not a requirement to get the SSN right after arriving in the US. You can wait until you are married and receive the EAD in your married name, if you wish.

It's just that the SSN has become a psuedo national ID number. Try getting on your spouse's employer's benefits without it. Try getting a bank account without it. Try filing a tax return without it. Hell, try going into the library in Harrisburg, PA without it (when I refused to give it they were at least civil about me not giving them my SSN, but it amazed me how many people put it down). There are a lot of things having the SSN make easier, and since you are going to need one sooner or later, why not get the process going now rather than later. That way if you have problems getting the SSN you can deal with it now rather than later when you are trying to get it so you can start working. Image you wait unitl the EAD card and get a great job offer a day after the EAD arrives. You run to the local SSA office only to be told they will not give you a SSC without the GC and give you some excuse. You then spend the next several weeks trying to the get SSA to issue you a SSC. In the mean time the job is offered to someone else who has a SSN and work authorization. Too bad for you.

Yep, thumbs up! I started working immediately after receiving EAD(interviewed saturday, started monday), didn't have to wait to apply for SSN and then wait for it in the mail. Just make sure that the name on SSN reflects the name on EAD.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

I can apply for SSN upon my entry in the US on a K1 visa or do i need to be married first before applying for it ?

Please start your own topic in the future. To answer your question; No. Some states require SSN to get married. I'd actually recommend applying for SSN, then getting married. And after getting cert. copy of marriage certificate, go to change from maiden name to married(if you're planning on it. All this can be done in that order up until the 76th day since POE. Both SSA and DMV will not issue anything 2 weeks or closer to the expiration of i94.

K1 process, October 2010 > POE, July 2011
