Received strange letter from USCIS, please help

My fiancee was approved for k1 visa in March 2012. However she failed the interview. She was given a letter mentioning "administrative procedure" and was advised to waited until contacted by the US embassy in Manilla. I guess the case was forwarded to the USCIS in the US. Today after 6 months of painful waiting I received the following 2 emails:

First Email:

On July 26, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

Second Email:

On July 26, 2012, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

What these emails mean excately? has the case been re-approved? Is the US embassy in Manilla required to provide the visa when they receive the case again from the state department?

I am confused, please help.

Your petition has been re-approved by USCIS....It is now going back to NVC and then back to Manila for a 2nd interview. Good luck to you.

One issue is that the US embassy in Manilla retained my fiancee passpor after teh first interview. The passport is still at the embassy which has stated that my fiancee should waited until further notice. Now my question is: Will be there a second interview or the embassy will just stamped teh passport and mail to her?

About that I am not sure.....The consulate may have needed to verify some information with CIS. So it is possible that she will be granted a visa with no interview.

Did your fiancee receive a 221g form? AP usually means they wanted to conduct further background checks because they were unsure of something. As the previous poster mentioned, they sent the petition back to USCIS, USCIS reapproved and sent to NVC to be sent to the Embassy. The embassy kept her passport so this is a good sign. If it was an outright denial, you would have been informed, and they would have given her the passport when you left the interview. I believe you will be getting a second interview so if USCIS has forwarded the petition back to the embassy, you will be informed, but it would be best to start contacting both USCIS and the embassy with the inquiry of the reapproved petition and when a possible date could be made for your second interview.

Contradictory informations here. The visa can't have been approved if she failed the interview. Or maybe you meant that the petition was approved, not the visa?

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

The petition has been reaffirmed, seemingly on the same day that USCIS received it (!). It's being sent back to the embassy. Expect anything from a pro forma interview (she shows up there, they grunt "we're granting your visa," she waits for it, and she's on her way) to a full repeat interview. Something in between, but closer to the former, is probably more likely.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

This may not be true...I received the same two emails the same day, and it was a clerical/computer error. It just means it was returned to be looked at. Does not necessarily mean it was approved. Mine is still in review.

By your logic.....everything we read may not be true.....everything could be computer error. Approval of an I-129F petition is the Department of Homeland Security granting permission for the beneficiary of that petition to now apply for a visa.

The I-129F was re-affirmed by USCIS and sent on , eventually the IV Unit in Manila will receive it.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
