Well, this is my Opus 1 post here. I have done some reading, but I'm sure asking can't hurt. My girlfriend currently lives in Toronto. She is beginning to look for work here in California. We would like to move in together as soon as possible but we don't know when she will be able to find a job here. I suggested that she come here and possibly freelance for her Canadian company and work from abroad until she can find the job she wants. So.. here are my questions:

1- Let's say we start the ball rolling on the 129 form... I understand she can come visit, but how long can she visit for without an apartment in Toronto and without a work visa?

2- What if we file the 129 form and she gets a job before that and gets a work Visa here... do we need to redo anything special after that or does the 129 process continue on?

3- Let's say she finishes her job in Toronto and comes here under my support to look for work and live... is this possible until the 129 is issued?

Timeline

I believe:

- Canadian's can stay for 6 months and as long as it does not look like they are trying to live in the US they should be fine. I have not heard of many Canadian's being denied at the border with a NOA1.

- The fiance visa is taking 6-9 months from start to finish.

- You can have a work visa and a pending fiance visa.

- Sure you can support your fiance and she can stay for 6 months that's fine but she cannot work without a permit and she can only stay for 6 months.

Be sure to read the K-1 guide and flowchart on this site along with the instructions included with the I-129F (the I-129 is a completely different thing) to get an idea of what's involved, what information you'll need to provide, and also know what she will need to supply once the petition is approved.
