Had temp greencard 2 years.. next step?

Hey everyone,

Our lawyer was asking way to much and money is tight right now so I figured i'd give it a go on my own. My wife and I have been married coming up on 2 years. Her temporary greencard expires on 2/15/2013 and from what I collected from the lawyer is that we can submit the next form(s) 90 days prior to it expiring. Now what is it we have to do for the next step? Hope someone can point me in the right direction.. our lawyer really screwed us over.

Look up and file the form I-751. It is very straightforward and does not require a lawyer. If her card expires Feb 2013, you can file sometime in December of this year, and no earlier.

just found that form too, the lawyer wanted $600 for that one form!! Unbelievable. Thank you

If everything's straightforward, you don't really need to be wasting time or money on a lawyer.

The process is called removal of Conditions and it's the easiest one there is.

Just follow the USCIS guidelines..send them whatever they need, get biometrics done, and, chances are, no interview will be needed.:thumbs:

Head to the removal of conditions forum. You can apply for ROC 90 days prior to to the expiry date...count 90 days backwards from 2/15/13 and you have your date when you can file ROC.

Good luck - read the ROC forum, read the ROC guide. Start getting your evidence together now so you're not scrambling come next Nov.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Actually, filing the I-751 costs $600. The lawyer may have wanted the same amount...I don't know...but just to file the I-751, you'll need to drop $600.

Having said all that, you really don't need a lawyer for this part of the process. Just read through the guides and make sure you file as soon as you're eligible (mid-November in your case). Be prepared to wait for nearly a year though.

hi, you will file her I-751 form which you can print it out on the website of USCIS, i think on november u should send the pocket out to uscis. u dont need attorney for this. here i copy of my cover letter, its a list of what inside of my pocket

Good day, Im _______ and me and my husband is filling a joint petition for removal of conditional resident for myself. We are happily married, living together and request that this petition will accepted for removal of my conditional residence and for my daughter.

Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship:

Form I-751

Copy of green card

Copy of our joint tax refund from 2009 - 2011

Copy of our car insurance with both of our names

Copy of the lease to our condominium

Some pictures of our family in important occasions

Copy of wedding invitation card from his cousin addressed to our names

Copy of our son's birth certificate

thats all u need if you can provide much better proof then your good to go, if you have a joint bank account thats good too, if you guys have health insurance together, life insurance showing that you are both the beneficiaries then include it.. anything proof that u guys are living together and happily married..

Hope this will help. Im done with this and i am the one who prepared my I-751 of course my husband helped me too but ive done all the work lolz. he want me to do it by my self b'coz its my I-751 :yes: and that's all i want lolz... today 3pm my biometrics app. then will be waiting for the new GC for months.. :D

As someone else mentioned, the I-751 process can take up to a year to complete - well beyond the 2 year expiration date. This is NOT a problem so don't panic. When you do file, you will get an NOA letter that states the 2 year card is extended for an additional year while your case is pending.

Do NOT lose this NOA letter.

If you travel outside of the US, carry this letter along with expired GC as this what will get you back in the US.
