Hi guys, please forgive me if i am posting my doubt on the wrong forum, I don't where to post it :bonk:

two weeks ago I applied for my EI online and sent my ROE along with some doc such as : copy of k-1 visa and I-94... and a letter explaining why I quit my job (to get married etc )

So, yesterday I got in the mail my access code and two papers of report (for 3 weeks of payment) .. I just got married, I don't have my marriage certificate either my EAD to prove.

Should I wait till I had my EAD or can I fill out the reports and send to them even without my EAD.. I haven't applied for AOS yet..

I just don't start receiving money illegally. Unless some rules have changed at Canada Service.

Please let me know if you have experienced something like that or if this is regular claims procedure.

You just finish the report and send it to Service Can and they will not mail you report cards again until you get your EAD. After you get your EAD you should send them a copy immediately and they will process your case and decide if you will receive EI.

I'm pretty sure this is province specific, but I know Ontario EI asks you if you have been out of the country, how long, etc. They don't want to pay if you are not available to work in the province. I've seen cases in the states where if they think you are looking to move to another state, they drop you.

ok just to be sure I am reading this correctly, you are stateside now, married and won't be going back to Canada. You will not be eligible for benefits because you aren't in Canada.

This is not true.

WRONG!! A Cdn moving to the USA to be with a spouse IS Eligible to claim EI. A k1 as the Op is aware, has to wait for her EAD. A cr-1/IR-1 since it already has work authorization can claim EI right away.....of course it all depends if they have enough qualifying work hrs while in Canada. Of course the Cdn Gov't is always looking to stop benefits, so maybe in the future this will disappear. Your EI claim will go thru the Inernational said of the house.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

As noted once you get your EAD, you will once again be able to receive your EI - you earned it fair and square. Doesn't matter where you're living.

I received it from the time I got my EAD until I started my job here in the US.

I called Canada Service yesterday and less than 4 hours they called me back. Yes, I have to fill out the report papers and send them to EI office. Once I have my EAD they will analyze my case and make their decision.

They asked for:

ROE

I-94

Work permit (Canada)

Visa page

EAD

I have sent them all except the EAD.

FYI ...The Max amount of weeks you can receive on EI is 35... It might have changed since I work for Service Canada (Sept 2011)
