K-1 or just get married? Confused...

Hi All,

Am a little confused with all the timelines.

I'm a UKC and my fiancee is USC.

From the forum I read that if she files K-1 it will be around 6 months before I can go to US to marry.

What about if we just get married outside US? Is that a faster route to us being together in US?

We would marry anywhere if it speeds things up?

Is it quicker to file I-130 in UK?

I think that the K-1 (fiance visa) is the quicker option. The K-3 (spouse visa) tends to take a little longer. Either way you look at it, you are going to be in for a wait. But, I hate to quote a time amount to you. At this time, people are being approved at all different lengths of time. Most of the time it does not matter what country you are from when filing for these things. However, some countries take a bit longer to schedule the interview. So basically either way you go it can be a while, but I chose in the same situation to go for the K-1. Hope this helps.... good luck!

Hello,

Generally the fiancee visa takes about 6-8 months to get approved and same is the case with the K-3 visa. It is just that K-3 visa has so many steps involved in it.

On the other hand you can also file for the I-130 petition at the US embassy in London, UK(DCF). It supports Direct Consular Filing. You need to get married in the UK for that purpose.

Someone Please correct me if I am wrong.

OK..I'll correct.

The US Citizen would have to be a legal resident of the UK before he could directly file at the US Consulate in London.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

My fiancee doesn't have a right to remain so DCF is out. And time line for K-1, K-3 are the same so no time advanage there...

I suppose that K-1 is longer route as you have to do all the extra paperwork for the marriage after you actually get married after the K-1 is approved, i.e. longer to normal life.

With the H1-B cap full for a whole year, and no other "non-immigrant/temporary" work visas available it's no wonder so many people dont bother and just do it illigally, not that I would ;-)

Yep, we can all relate! I left London Oct 05 & he will be here on a K1 Nov 3/06. Not pretty but we didn't know about the K1 til April. I was one of the quicker ones.

The K1/K3 are about even now. Depends on what you want to do. Lots of K1 filers do not want to marry then live apart form their spouse (what's necessary for K3). I certainly didn't.
