Your timeline totally confuses me! You got the NOA1, cancelled the petition, then adjusted status?

MOst likely due to the emergency mentioned in signature. It's legal to cancel/withdraw a petition and AOS from within the US if already here, and it's due to something unforseen/unplanned. It's also a loophole, which is most likely why the NOA1 from i-129f isn't a guarentee anybody will be allowed to enter the US with a pending petition.

I agree that you should notify the USCIS and the U.S. Embassy Manila that you want to withdraw the petition.

However, I doubt it's a good idea to tell them that you threatened to post her nude pics on the internet, and that you wanted to cause MASSIVE TROUBLE for the guy she married. :whistle:

I agree with Tahoma. You probably should leave out all the threats you posted here on VJ earlier. While you were probably just hurt and reacting in anger, it just doesn't shine a very favorable light on you. It is pretty crappy to threaten posting private photos of someone that you claimed to love at the time.

Just withdraw your petition. Heal yourself from this relationship. Maybe next time try investing a little more time into any future relationships to get a feel for how you 2 cope together.

I agree, withdraw the petition, send a copy of the NOA1 and your letter. I just finished reading a topic where the beneficiary was denied at the interview because the ex-USC-fiance did not withdraw the petition from years earlier(if I remember correctly). For your sake, if you were to petition a fiancee later on, make sure your current petition is cancelled.

Wait so it really is a big deal for me to actually write them and CANCEL/WITHDRAW my petition? So you're saying that if I dont do this and I choose to petition another girl in the future that I might be automatically DENIED just for not canceling my 1st petition? Is the 9/1/12 deadline not enough for this petition to just be "forgotten" and "over and done with" so that I could start over once again?

Yes, you can only petition one fiance(e) at a time(as weird as that may sound).

The embassy has the right to extend the expiration date/validity. If the letter never got through to USCIS/embassy, then USCIS will forward the approved petition to the embassy, and the embassy may extend the valitidy of it or until it's considered abandoned. For your own sake, cancel it if you're 100 percent sure that you will not be following through with your petition. The fee you paid is non-refundable.

I don't really blame you. If you decided to brake it off, rather now than a year later when you're on the hook for good and you've spent more than just the 340 dollars for a petition. However, I'd recommend visiting a few times whenever possible and simply enjoy each other and each other'c culture before things turn stressful through an immigration process.

Edit: And since you already have the NOA2, it won't hurt to contact NVC(National Visa Center) either. All approved petitions fly through there and get the new embassy case number assigned. Sending a letter to them would probably be a good idea, too. And getting the new embassy case number(if it has already been forwarded) and add it to your withdrawel letter to the embassy along with NOA1/NOA2 is just covering your a** the best way you can.

You have been making posts on this situation since February that I know of. In one thread, you went from professing love for her to threatening her here on VJ. Moderators had to close your thread. It obviously did take a turn for the worse.

My point is this, how many times did you visit her? One visit you obviously did not see her as she was "hiding" from you. Your quote was, "From the entire time I've spent here, (since jan 6) you can almost count on 2 hands the # of days she's stayed with me" (posted Feb 16, 2012 which makes you there about 6 weeks when you posted that). That one doesn't count. Based on another thread of yours, wasn't she already married then to another guy at this time? Face it, you were taken for a ride.

So my advice isn't so soft. You should try getting to know each other better, i.e. investing a little more time, in order to find out more about them. Like if they are married or not.

Thanks moomin.... so basically what you're saying is that even after the expiration (9/1/12) that itself wont automatically be a valid enough reason for me to petition again? Cuz technically I wouldn't be able to pursue THAT application anyway since I didn't do anything to forego the process right? Because I dont even know how professional or whatever to make these letters, or if I need to get them certified, and all other details.... can someone post the address and format of what exactly I should tell them? And does me writing them guarantee that I will have an equal chance to petition someone in the future if need-be? I just dont want to screw myself over and want to do the right thing. guys i got a question from here... its quite related about leaving the one behind.. i just wanna know.. what if they're married here in philippines? and the guy decided to leave the girl, what can a girl do for the guy since we all know that Philippines dont have a divorce? and so that the guy cannot marry another girl. is it possible to register the marriage license in America? how to do that? i just wanna know.. lol.. nothing personal.

It's not necessary to register the marriage in the US. A marriage obtained in the Philippines is legal in the US. If a guy is married then he can't legally marry again without first obtaining a divorce. If he got married without getting a divorce first then the second marriage would be invalid. There could be all kinds of retroactive backlash if it's later discovered that he was already married when he married the second girl. Any jointly filed tax returns would have to be refiled, along with penalties. Any immigration benefits granted based on the second married would be revoked. The list goes on.

The fact that divorce isn't possible in the Philippines will have no affect on the guy's ability to obtain a divorce in the US.

You never pointed out that the whole "married to the 63 year old man" that you were seeking revenge on was not actually a marriage. Your post about that whole situation

Just write them stating that you are the US citizen petitioning on behalf of her name.

Give them your application #

Tell them that you wish to withdraw your petition. It may be advantageous for you to send a photocopy so that they have any and all of the information they may want at their disposal.
